In the UK, he would have been arrested just for what he's wearing - illegal to impersonate a police officer and that includes dressing like one so others wouldn't know he was retired, so, take your choice........

Over here, retired soldiers wear their dress uniforms all the time, particularly for ceremonies and VFW meetings. I imagine the same would go for retired police captains.

Again, NYPD is doing it wrong. The protest is a symptom. The proper role of the police is to find the cause of the disease, the people who victimized the protestors, investigate those people to see if they have broken any laws whatsoever (and they probably have, since supposedly everyone in the U.S. commits three felonies a day without realizing it) and then arrest those people. The protest will disperse spontaneously when the conditions that caused it are alleviated.

Look up the Bonus Army sometime. And the city could just provide a space for the people and let them at it, after all the people aren't protesting the city government.
