There is nothing fundamental about his character that ever required him to be white. Samuel Jackson was a great choice in my mind.

Storm has to be black because she came from an African village, part of her origin narrative. Thor pretty much has to be white with the whole Norwegian mythology thing.

If you had to retcon it, I would make it that he was always black but disguised himself as a white person for a particular mission or to move up the ranks in a military (many years ago) that prevented advancement of black people.

So picture this: Nick Fury under the direction of the US government, has been told that black communities in the 80's were being quietly poisoned my red-skull through the creation and distribution of crack. Fury agrees to undergo surgery to blacken him so he can infiltrate red-skull but something goes horribly wrong! And he ends up with the genes of a black man. Is it cliched enough?

On the second, good question; everyone with powers in the DCU is a meta-human be they mutant, magic, alien, or other however I can't think of a blanket term for powered beings in the MarvelU. Anyone in the Fark hivemind know?

Seriously they pull from all over. Its annoying to hear people keep saying they are based off the Ultimates. which they really arent anymore than any other interpretation.

Some more Nerdage here, but while none of the founders were filthy mutants, the Avengers typically do have mutant members.

Its more of a DC term but "metahuman" has been used before. sometimes the awkward phrase "people with powers" is used.
