Do counts 2 through 25 count as the 2nd through 25th offenses for the repeat offender law? The corresponding rule in federal gun law resulted in some ineffective internet rage a few years ago. Some guy in Utah who owned a gun and sold pot got effectively a life sentence for repeat offenses of possessing a gun in connection with a drug crime. He was convicted of them all at once but the way the law works is the same as if he had been convicted after two separate prior convictions.

I misread that as something far more inappropriate than drunk driving.

I agree, blowing a three month old is horrible, but I don't understand how that has anything to do with DUI laws.

Bail was set for Crockett at $10,000 for the disorderly conduct offense. Superior Court Judge Michael Haas set bail on the endangering charges at $75,000.

Crockett posted bail and was released with an upcoming court date of Nov. 17.

Wow, a school bus driver posted $85k bail? Nice.

That seems excessive, but if you had a child on that bus, you would not shed a tear for her.

You're really not kidding. I've knew an old hag of a lady that made 100k a year after like 30+ years of service. That, and her house was located on old farm road 30 years ago become the suburban strip mall road today. She sold her run down god awful house to a bank, probably pulled a cool million at least.

Who would thought 30 years ago taking a shiat minimum wage municipal job would have made her one of the richest people in suburbia.

And somehow they will be unable to fire her due to the backing of her union. I'm betting she is on paid vacation right now, eh?

So it's OK for a school bus driver to blow a 0.25% if they're only charged for one offense?

suburbanguy: So it's OK for a school bus driver to blow a 0.25% if they're only charged for one offense?

They only drove drunk once.
That law is ridiculous and should be challenged. It shouldn't matter how many people or kids are in the car, you're still only driving one vehicle, once, drunk.

How did such a knee-jerk, ridiculous law get passed?

cgraves67: That seems excessive, but if you had a child on that bus, you would not shed a tear for her.

FTA:
"25 counts of endangering the welfare of a child."

Because there were 25 children on that bus. If you murdered 25 people in one shot you'd be charged with 25 counts of murder, you wouldn't get away with only one charge because it all happened during the same incident.

2011-11-10 02:16:39 PM
I just got a jersey red light camera ticket in the mail last week, so I'm getting a kick out of this article.

// Not really, I just had to cancel a check I sent in for a charitable donation to cover the cost of the cash grab. Sad.

So 1 count of driving while intoxicated, and 25 counts of endangerment? That's more understandable than 25 counts of DUI.

2011-11-10 02:20:54 PM
Look, I know MADD keeps moving the goalposts to the point where Carry Nation would go "Wow you guys are hardcore," but I can't really argue with this one. If anything, the time served should protect her from a mob of angry parents with torches and pitchforks.

Mr Guy: So 1 count of driving while intoxicated, and 25 counts of endangerment? That's more understandable than 25 counts of DUI.

Okay, yes, if that's the case, I can't complain about that because it's accurate enough.

25 counts of DUI makes no sense, though.

Just another example of how meaningless the Constitutional limits on government power have become.

Only a bunch of lawyers could twist the plain language of the Constitution so that it doesn't mean what it actually says.

2011-11-10 03:21:39 PM
Ahahahah reminds me of the woman who was high on meth and hit the bus my landlord was driving. She was charged with 53 counts of child endangerment, besides possession of methamphetamines.

2011-11-10 03:34:22 PM
Latinwolf: "25 counts of endangering the welfare of a child."

Ah, that makes more sense.

Although in cases like this, where the crimes were committed concurrently the sentences should run concurrently as well.

The legal system has gotten so obsessed with punishing criminals we've lost sight of doing justice. Right and wrong no longer matter, the only thing that matters is absolute compliance to the government's dictates.

Yup, she probably put up her house/car/whatever as collateral to the bail bondsman. And that item probably didn't need to be worth the full $85k, either.

Heheh. My middle school bus driver was an old school hippie. Smelled like weed everyday, the bus always smelled like a Lysol can exploded, he cut turns, and didn't give two farks if he side-swiped your car. Oh, and he owned a 45% stake in the bus company somehow. So he was loaded, and incapable of getting fired. He also would offer you some of his possum jerky if he had some. That shiat is nasty.

/He was still awesome

CSB time...

When I was in college I worked at Starbucks briefly. During my 1st week, I opened around 7am one morning and a shaggy looking fellow came up to the counter, with slurred speech and a little stumbling. He told me to hurry up because they were waiting, and I said "Who's waiting?". "The kids on the bus" he said. He then told me in comically slurred speech that he was a bus driver for the middle school, and that he was in a hurry because he was late and would have to speed to school if I took too long.

I pulled out my cell phone and was trying to decide whether to call the police myself or tell the manager, when the manager and another employee came up to me barely containing their laughter and told me that this was a regular customer, he was not a bus driver, and he was just having some fun with me.
