Are crimes like this...illegal to...plan?

Like, I know you get in trouble if you plan a murder or something. But if someone were to PLAN to have sex with some lady and her teenage daughter, would they be arrested?

If not, how in the world is it an arrestable major offense to get caught doing so via a chatroom? It wouldn't even BE HAPPENING if not for the officer going along with it...the "crime" would not exist at all without the officer, and DOESNT exist at all if it's not illegal to just talk about doing.

2011-11-10 12:17:09 AM
Came here to say entrapment too, but the cops also do it live with female cop actors, playing prostitutes.

I guess the Judges don't have a problem with entrapment via prostitution.

What do they do when they're fishing for predators and they end up with a clingy 14 year old boy? Poor kid probably goes through life bemoaning the one who got away.

Just once I think it' be funny if a 14 year old boy pretended to be an older dude to seduce a chick who was obviously into older dudes and then the cops arrange to meet the 'guy' and catch the kid. Then what? Is the cop guilty of arranging to have sex with a minor?

And if a woman will prostitute her own 14-yr old daughter why would she hesitate to knock you out while you are on top of her child, kill you, then take all your money before dumping your corpse in an alligator infested pond?(it is Florida after all)

I guess I'm too suspicious to fall for this whole scenario plus I'm not a child molester so there's that too.

I'm not going to bother with reading the article, but entrapment means they enticed you into a crime you otherwise would not have considered.

Chatting with someone online, inviting them over and getting them hot and bothered and then asking, hey, would you like to stick that thing in my 14-year old daughter is almost certainly entrapment.

Not sure how this one played out, but if the accused was all like "i wanna bang you and your daughter I don't care how old she is" it's not entrapment.

It's equally illegal to "attempt" most crimes -- attempted murder, attempted burglary, etc. Attempt becomes punishable where: (i) you had an intent to complete the crime if things worked out; and (ii) you took a "substantial step" towards completing the crime. Here, driving to the spot of the "meetup" with the "mom and daughter" would be considered a substantial step.

Nowadays, there are state statutes that specifically prohibit internet-based solicitation of sex with minors, so the guy was done for as soon as the chat took place. But you could still fit this under old common-law concepts of "attempted ___" if you needed to.

I'll never understand this phenomenon. It's like a perfect storm.

There are men out there who are so utterly deluded that they think a 14-year old girl is going to want to hook up with a slovenly, pudgy, 45-year old with halitosis and a skin condition, who still lives with his parents, and that said 14-year old is going to seek out said man in Internet chat rooms devoted to discussing outrageously unrealistic sexual escapades.

There are law enforcement officers out there who willingly spend their time trolling chat rooms, pretending to be unrealistically precocious children. They practice and hone and perfect their art of sounding like flirty little girls and try to drive these slovenly, unattractive men mad with desire.

Then these two species of subhuman are drawn to each other like moths to a flame, and we spend hundreds of thousands of dollars to put the delusional guys into prison for decades.

I think Americans just have way too much time on our hands.

Except in other incidents you actually get prosecuted for conspiracy. For terrorism, you're treated as if you carried out the crime. For pedos, you're convicted of sexual assault you never committed and are branded a sex criminal for something you never did.

These are the only two areas where we have thoughtcrime. Why is it acceptable here?

conviction on conspiracy to commit a crime has two elements that are required.

1 planning to do something
2 taking actions toward that goal.

like planning to blow up a building isnt a crime. planning to blow up a building and buying 15 bags of fertilizer makes it a crime. also, just buying 15 bags of fertilizer isnt a crime.

so in this case

1 planned to commit a crime
the guy "a six-year veteran of the East Naples Fire Department"

AND

2 took action towards that crime

was arrested Thursday in Hardee County, located about 100 miles northeast of Naples, on charges of soliciting a minor and traveling to meet a minor

I was in a chat room once when someone purporting to be a kid came in and wanted us to tell him how to "deface" web sites. Yeah, let us tell some random stranger how to commit a federal crime in an open chat room. That must have been before the cops started giving their operatives entrapment lessons.

This.
It's also the reason the cops can use bait cars and bait bikes to catch thieves.
Entrapment would be if the cop said, "Hey why don't you go steal that car there!".
They also use ordinary bikes/cars so they don't create the incentive to commit the crime - not parking a $200,000 car in the street, for example.

Condoms. And I doubt he worries much about it. He mostly farks porn stars and they all have it, bonus that most in porn industry are checked of HIV. In that lifestyle it's no less common than acne on teenagers.

I'm sorry, but where is the entrapment in this case? As for thoughtcrime, they weren't charged with thinking about or fantasizing about having sex with a 14 year old girl. They were charged with acting on that fantasy by setting up a meeting and then going to that meeting. They're not being punished for their thoughts. They're being punished for their actions. Huge distinction there.

Seems a lot of hassle going onto some chatroom to get sex with a teen. All that driving, finding the house, bringing candy, hiding under the bed if the parents came home, possibility said teen is a FBI agent etc.

Just grab them off the street. That's what I do. Less chance of them being from the FBI since you can see their faces.
