not sure what you said there. But, Louisiana is not a common law state. It does not recognize common law marriages in Louisiana (I think we have to recognize a marriage if another state says it's a marriage, but you will not have a common law marriage by living together in Louisiana... we're civilian afterall).

However, Louisiana is a community property regime state. While in the marital regime, there is a community of the acquets and gains. Meaning husband and wife are equal owners in indivision of all acquired property (unless it is specifically separate property, such as that which is obtained by will, separate funds, or if there is an agreement denying the community regime).

This means that any money the man makes by his work is co-owned equally by his wife.

Unmarried people mistakenly think that they are enjoying a community regime. When they break up, they think they have a right to property as if it were a community regime (falsely assuming that they had lived together long enough to enter into a common law marriage). This is a problem, because often the man or woman will quit their job to make house, and then when the relationship ends, they are in dire straights with no recourse.

Two Hearted: You have to express your intent to have a common law marriage. That is, if it's recognized in your state in the first place.

That's the point. In Louisiana there is no common law marriage. It is not a legally recognized concept. Usually things that say common law in front of them we tend to avoid (or we find a latin word to use --> life estate = usufruct (very very roughly)).

I'm confused how can you divorce someone you never legally married. The act of divorce requires the act of marriage.

Also men should never get married.

well, don't know about other states, but your net worth does not enter the equation in LA. Only the gains while married, and they are split because she owns half of the fruits (just like you own half of hers). But, this only applies to gains while in a marital regime.
