Since the government screwed this one up for so long, clearly we shouldn't have the government investigate the qualifications of expert witnesses at all.

So long as Phil McGraw gets to practice without a license on TV, it's hard for me to give two shiats about this penny-ante hustler.

Is this the Doctor that verified President Obama's birth certificate was legit from a medical point of view?

Dr. Terlep stated: "President Obama was a newborn when he was born"

He practices on TV to people without charging them and not in a court of law. This guy might have seriously screwed up peoples lives.

Okay, so might Dr. Phil, but at least the people didn't pay him to do it.

He is a job creator.

I want to go into private practice in forensic psychology and it makes me a sad panda to know that I'll have a much harder time breaking into the field than this arsehole.

I like how you're seriously up in arms about a TV doctor that makes no bones about the fact that his license to practice is expired and that his show is designed as entertainment but don't "give two sh*ts" about a guy that never had a license, lied about it and provided expert testimony under false pretense that was used when deciding court cases.

Your ducks, sir: possibly not in a row.

Also, FTA:

"When someone comes into court, he's told to raise his right hand and swear to his qualifications," Switalski said. "If that person doesn't tell the truth, then it's clear where the problem is."

Yes, the problem is the part where you assume that raising your right hand somehow prevents people from lying. Oh wait, you meant the responsibility for the deception.

Different thing entirely.

I think the problem was that no one was investigating the qualifications of expert witnesses.

This has happened before. Lives have been ruined.

Link (new window)

Just imagine. One of your kids dies an accidental death (an absolute heartbreaking event in itself) and this total scumbag ruins your life even more. And of course, the farkin' useless greedy cold-hearted bastards in your government won't compensate you without a fight.

Justice???

Why's it never light on my lawn
Why does it rain and never say good-day to the new-born
On the big screen they showed us a sun
But not as bright in life as the real one
It's never quite the same as the real one
chorus
And tell me grey seal
How does it feel to be so wise
To see through eyes
That only see what's real
Tell me grey seal
I never learned why meteors were formed
I only farmed in schools that were so warn and torn
If anyone can cry then so can I
I read books and draw life from the eye
All my life is drawings from the eye
[repeat chorus]
Your mission bells were wrought by ancient men
The roots were formed by twisted roots
Your roots were twisted then
I was re-born before all life could die
The Phoenix bird will leave this world to fly
If the Phoenix bird can fly then so can I
[repeat chorus]

It doesn't count as fooled if the government declined to ever inestigate in the first place.

Well... if it's been working for you, it's been working for you... but it's probably time to find a new therapist.

I've spent time with a couple MSWs and Nurse Practitioners, as well as with the "official" Doctors, and I can't help but think a lot of the stuff that real doctors have to do, is more because of official rules than any lack of skill on the part of the MSWs/NPs.

Same with my annual physical. I spend most of the time with the nurse, phlebotomist, etc., then the doc comes in, fondles my nads, and signs off on everything. Then a couple weeks later I get a call from another nurse telling me my cholesterol is a tad too high and that the doctor recommends diet and exercise improvements.

My mother isn't taking medical advice from this particular quack, nor are millions of other scientifically weak less-than-skeptical women.

Hypothetical Imperative: I'm quite certain that my ducks have been goosestepping in parade formation, thanks.

Okay, so might Dr. Phil, but at least the people didn't pay him to do it.

Are you suggesting Phil McGraw is doing his show gratis? I'll need a cite for that, thanks.

Nurses learn and retain a lot on the job, but have less overall knowledge than someone med school educated and residented. Doctors have that depth of knowledge, but tend to forget a lot of procedures by not being in the trenches every day. Not to say nurses are stupid, but the two are more complimentary than one being greater than the other - God complexes notwithstanding. Where a nurse might be able to research and discover the cure to a problem, like any of us could, doctors are supposed to be able to know symptoms, potential causes, and cures off the top of their heads, and keep up on current research. Of course, the requirements for nurses today are similar to the requirements of family doctors of olden days, which explains why they're so much more useful for day to day problems.

And now any idiot can look things up on WebMD and the same web forums where doctors post mystifying problems to each other, so everyone's time is less wasted.

This:  "I think the problem was that no one was investigating the qualifications of expert witnesses."

No one EVAR investigates the qualifications of expert witnesses.

I can't remember the case citation, but there was a famous NC case wherein an "expert witness" convinced a jury of innocence based on "the forensic anthropology of footprints.".

Later it was discovered that the purported phd and expert was just a lay person who made up the entire scientific basis of her testimony.

The "corrective" response of the courts:  not to do a background check of the witness; rather all witness must satisfy a general list of conditions set forth by the court.

So what does that mean?  Expert witness have to falsify their qualifications more carefully.  expert testimony, in the meantime is no more accurate.

Pretty far, actually.
