I swear there was a very similar FML posted yesterday. The main difference was the person writing it (who was the theif) was working at a store when he/she was found out.

When I was a substitute teacher, we had a teacher who lost her cellphone and couldn't find it. So we're at the secretary's desk, and there's a couple of students standing around at the same time, while a TA is in the room listening for it as she calls. We heard the ringing. The student who swiped the phone pulled it out of her pocket in front of us all and answered it. She wasn't a very bright girl.

\Happened the same year her sister, another mental giant, decided to keep her fundraising money instead of turning it in. Her vicitms? Myself, the secretary, the after-school coordinator, another teacher, and the vice-principal.

Maybe the guy's own phone had the same ringtone. Unless the cops called the number, but would that make it an illegal search (presuming no warrant)?

Had the same thing happen to me, sort of...

My phone was stolen. I got a replacement, and called the old number. Seeing as I had the code, and the thief didn't, I changed the voicemail message to "Hi. If you are trying to call Jim, sorry, my phone has been stolen, and my new number is: XXX-XXX-XXXX. If you are NOT trying to call Jim, you are probably trying to call the person who stole my phone. If so, please call me, Jim, at XXX-XXX-XXXX and let me know who the thief is. Thank you."

Eventually, I got a call from the thief's former parole officer, who called the thief who was appearing in court. She heard the phone ring, in the courtroom, and then go to voicemail. She then called me, and gave me ALL SORTS of information about the thief. The police, however, wouldn't be bothered driving to the perp's house, despite my having done all their work for them. Gotta love the Big Island police.

Him being a dumbass is not in dispute. He stole someones property. The level of dumbassedness may be in dispute.
What happened after the cops called the phone, which is not, as usual, related in the article, is the key information.

"Brrriiiing!"
"Sir, can I see that phone?"
Either they beat his ass to take and inspect the phone, or he gave it up.

Since we are not reading of a possible police brutality lawsuit, I leave it to you to decide which one happened.
In the situation of *you know you are guilty*, what do you do? Cough up, or get your ass beat until you do cough up.
