I never understood why CBS got the fine anyways. It wasn't like they knew in advance that Timberlake was going to expose Janet. It was an "Oh shiat! Long shot! Long shot!" If anyone should get a fine it should have been the performers...

This article explains the FCC's theory:
The FCC argues that Jackson's choreographer had suggested that something might be up. During the act, Justin Timberlake ripped off Jackson's bustier, exposing her breast for nine-sixteenths of a second, which 12-year-old boys collectively decided at the time was the greatest nine-sixteenths of a second in television history. It was explained away as a "wardrobe malfunction," a term that has since become part of the lexicon.

"There were considerable alarm bells about deviating from the script," FCC lawyer Jacob Lewis argued before the 3rd Circuit last year. "CBS had a duty to investigate."
CBS was supposed to be aggressively working to prevent any accidents.

Too many government rules are enforced by the agencies that make them using lax standards and low burdens of proof. Violations should be handled as criminal prosecutions with the burden of proof on the government using the beyond a reasonable doubt standard.

Well, to be fair the PTC has a point with 9/16 seconds of a boob and 90 million viewers. That comes out almost 586 days of nudity straight.

(90000000*(9/16))/60/60/24= about 585.93

That's a lot of boob but so is the PTC

They're the ones who can't get over that their little 'morality' about sexuality has made them euuchs and robbed them of some awesome times, so they swallow their regret and suddenly make their identity all about 'family' and their repression while the taxpayers foot the bill.

Nothing makes money faster than squealing for Jesus because your child--who by this point is already farking and sucking and doing nastier stuff than seeing a nipple on TV--might have been traumatized by this. In the federal system judges receive pay for life. When they reach retirement age they can choose to keep hearing cases, or not. Some have refused criminal cases because they don't approve of the way the war on drugs is being run. They are available to hear about nipples instead of narcotics.
