See Apple? THIS is what the legal system is supposed to be used for... helping people. And when there's something stupid about your lawsuit, YOU DROP THE CASE.

To me, it sounds like MS used the lawsuit as a way of getting a hold of those domains immediately to find the C&C centers and deal with them. Once that was done, drop the lawsuit against the company that hosts them, and assist in making sure it doesn't happen again. Kudos, job well done by all it seems.

Usually I just try to nuke the construction yard, but that sounds like a better strategy for C&C.

Yes, but they were initially claiming that Piatti was one of the people in control of the botnet. I agree that using a court order to shut down the botnet was in order, but the lawsuit seems to be a separate action after the botnet was down.

"After reviewing the evidence ... we believe that neither he nor his business were involved in controlling the subdomains used to host the Kelihos botnet," said Boscovich. "Rather, the controllers of the Kelihos botnet leveraged the subdomain services offered by Mr. Piatti's cz.cc domain."

So it seems at some point they thought Piatti was in control of the botnet. They sued first and asked questions later.

As the article stated, parts of the botnet were on servers owned/hosted by him. He ran a free hosting site.

Iirc, he initially refused to take action against the botnet on his servers so they sued him.

just because they were the victims of the bot-net people not the criminals themselves doesn't mean that they should not go after them. Go after everyne involved. Go after the owners of zombie-computers. drain the swamp I say.
