The cops had her take a breath test and found out that her BAC was .17% (more than twice the legal limit) which qualifiers her as a Super Drunk Driver, according to a new Michigan law.

In my state if you're convicted of a DUI and you refuse to blow when you're pulled over again sometime in the next 20 years, you automatically get a DUI. Actually, no, you're automatically charged with "refusal with prior DUI," which carries the same penalties as a regular DUI. I asked a lawyer: "but even if you have a prior, if you think you'll get a super DUI if you blow, wouldn't it still make sense not to blow and just get the automatic 'refusal with prior' than risk getting the super with all the increased penalties?" His answer was that he couldn't really answer my question, because by advising a client not to blow, he would be advising them to commit a crime (which lawyers apparently aren't allowed to do): the crime of "refusal with prior DUI." Whee!
