Isn't prior use more for patents? I seem to recall something about Trump filing for the trademark "You're fired!" and some woman had already had that trademark for ceramic cups (although only in a certain selling radius).

I'd think "You're fired!" would have plenty of prior uses. Sorta like how Microsoft has the word "Windows" trademarked. Plenty of prior uses for that word.

/still doesn't know who the good/bad guys are supposed to be in this dog fight.

I wasn't for or against the occupy protesters until Wells Fargo just halved my Credit card limit from $7,000 to $2,500 (I had a 5k balance), and raised my intrest rate by 3% just before a bill and statement were due to be sent. They applied a fee for being over my limit, and put a ding in my credit score. Personally I hope the protesters in San Francisco storm the HQ and execute every motherfarker inside.

/Yes I know WF sucks, but they were decent(ish) for the last five years.

Prior art would be for patents, but prior use can be used to allow the original user/users to continue using it if they can prove that they had common-law rights to it in the areas they used it before it was registered.

Some are violent, some are not. Some are ludicrous. And I totally believe it about the unsanitary conditions, though I'm not masochistic enough to go down and confirm it.

I suspect such things are happening elsewhere. But "lots" is a subjective assessment.

Jeez, that would piss me off so much. I think the first thing i'd do is speak to a lawyer, who would charge me £200 to tell me that what they did was perfectly legal and because the banks run the country there are no laws for common people to seek redress from unjust actions perpetrated by banks. Then i'd go sit in Occupy London.

what really needs to happen, is have a tea party vs OWS rumble. in new mexico, 20 weeks from now, to allow both sides to send as many members as possible. hell the govt could pay for buses. bring in all the people and all the politicians for a big televised debate, and then drop the nuclear arsenal of russia and the USA on them.

To be fair to them, they tried to occupy the London Stock Exchange but the Met directed them to St. Paul's. If the police opened up Paternoster Square then not only could St. paul's carry on as usual, the businesses in the square reporting dips in custom would get a boost. The only downside would be the money handlers getting some good-natured stick but NOOOOO, we can't have that can we!

But yes, I think they should move from St. Paul's, it's not really a relevant place. If they want to hamper bankers then they could do much worse by occupying somewhere around Bishopsgate.

IANAL, but even *if* he gets a trademark, that won't stop anyone from using the phrase "Occupy Wall St." unless maybe you're selling OWS T-shirts or similarly engaging in commerce. Starbucks is a trademark name, but I can still go online and use the word "Starbucks" and tell people how much Starbucks coffee blows. What I can't do is open up a coffee shop called "Starbucky's".

I've also heard that they fill up with anarchists and the homeless, so things should get interesting soon. That's if there's anyone left - the London chaps are all buggering off home for tea and cakes and some sleep in a comfortable bed as the nights draw in.

I'm not sure anyone really needs to do anything on the scale of the Oakland effort - just wait until winter and nature will do her thing and freeze them out. I don't that approach will shift the Occupy Maui guys anytime soon though.
