It took all of this time for the shame of composing "Talk Dirty to Me" to fade, I understand.

I used to think Posner was a pretty bright guy, probably headed for a seat on the SCOTUS, but after reading several of his opinions and a couple of his books, it seems he's really more interested in defining law than interpreting it. He's also obsessed with cases that have some sexual aspect to them.

It's really no wonder many other courts have rejected Posner's "continuing wrong" concept and gone with the more logical and realistic statute of limitations. And really, Ride the Wind? That came much later when Poison was going through their country/blues transformation. It really isn't very 80s hair metal. Would a band from that era have come up with something like that?

Doubtful.

They're going to have to explain why they waited so long to file the lawsuit. I get that TFA mentions one case where it was OK, but they're still going to have to explain it. It's not like Poison is an obscure band with songs these guys had never heard until just now.

Obviously, somebody's rock-n-roll party days in the 80's are starting to rack up the medical bills now and they're looking for some quick money to make them go away. Good luck with that.

/met CC DeVille at the House of Blues on Sunset years ago - he hit on my sister

Why did they wait so long to file suit? Easy - this is the musical equivalent of a patent troll lawsuit, They're hairband trolls. Attorney knows it, that's why he merely said "Well, that is a good question... b-b-b-but here's a case that supports us. Let the discovery roll, mountains of paperwork, summary judgment motions. They think Poison will think it cheaper to settle. In the meantime lotsa folks getting lotsa (sort of) media exposure.

Actually, if you remove the vocals and just listen to the music, Poison's first album and the Sex Pistol's first (and only real album) are pretty damned close musically. Sounds crazy, but check it out.

Besides the bands mentioned above there's the awesomely cheesy action flicks from those days. They just don't make 'em like that anymore.

If Poison stole your songs, why'd you wait so long before filing a lawsuit? This is no different from when about 18 years ago, some idiot filed a lawsuit against ZZ Top, claiming years after the fact that they stole La Grange from him

So, the Fark consensus is that the music of the 80s sucked except for almost every
band that put out anything at all.

The bands were started within a couple years of each other in a genre that unless you're a devotee it can be hard to tell various bands apart from one another (though to be fair that applies to just about any genre of music).
