Yes, the penalties are much more severe. The example in TFA is of someone who is growing six pot plants - any more than 5 and there's a huge increase in minimum sentences, which is particularly problematic for people who grow marijuana for medicinal purposes. The biggest sh*tshow in this act's writing, though, is the two-year minimum sentence for trafficking marijuana in/near schools or "any other public place usually frequented by persons under the age of 18 years", which as should be readily apparent, could be anywhere. "Trafficking" is not just selling, it is defined in the Controlled Drugs and Substances Act as:

"traffic" means, in respect of a substance included in any of Schedules I to IV,

(a) to sell, administer, give, transfer, transport, send or deliver the substance,

(b) to sell an authorization to obtain the substance, or

(c) to offer to do anything mentioned in paragraph (a) or (b),


I also think the Québec National Assembly's unanimous resolution in opposition to Bill C-10 is a very, very bad sign. We're only a few months into Harper's majority and you can already see a Québec vs. the Rest of Canada narrative shaping up. The major objection by the Québec NA is of course the stricter treatment of young offenders, which is also in the omnibus bill.

As a criminal defence law clerk, I FULLY support this new law. The amount of trials, the pay raise, the 11(b) applications... I can't wait for this law to be proclaimed in force!

Lol. I got smoking in high school. The school admins gave me detention for a week. That's it.

Yes it is legal in Ontario, because of a Court of Appeal for Ontario decision... This new law *can* have an effect on that decision, however, because of the division of powers, the courts are free to rule that part as unconstitutional, or even ultra vires of Parliament. Our Courts have consistently ruled that Parliament can't legislate morality, and that's what they're trying to do.

This - cops still have to arrest you (Think there gonna arrest every person in canada they find passing a joint? Ha) Then the judge has to be dickish enough to be ignorant of the spirit of the law.

CSB: in my town 2 rcmp (brand new recruits from Quebec) caught a 60 year old man for public indecency after they caught him peeing outside a bar at 2AM -- the judge told the cops that if they ever brought anything so trivial infront of him again they would be out of work very fast.

If I'm not mistaken, public indecency requires the consent of the provincial Attorney General... if the case was brought in front of the judge without that consent, then yes it would be tossed as a matter of law... I could be mistaken, I know public nudity requires that consent, my Criminal Code is five meters away from me in my bathroom. In any case, that is stupidity at its finest.

The Toronto Sun is just embarrassing. Usually the cover's headline is some stupid crap of a story ("Crack Mom!") but every election season it turns into blatant conservative campaign ads.

I was seriously surprised that they didn't just say screw it and run with "fark Iggy" or "fark McGuinty" near the end.

I was listening to circlejerk conservative radio today(Roy Green on Chorus Radio) and he had some douchnozzle that wrote a "book" called "Why only Conservatives have their head on straight" or some bullshiat name like that. Anyway, Roy is all "we have watch out, because this country is run by left wing media that has taken over, and they are like an echo chamber, repeating their nonsense and agreeing with each other." Then douchnozzle book guy says something retarded about how awesome conservatives are, and Roy is all "I've been saying that for years! You are so right, and we have to keep saying these things." Not realizing the utter hipocrasy of what the hell they were doing.

Then he finishes with "you're my hero" and douchnozzle book guy is like, "no, your my hero" and Roy's like, "well, ok, but you are still my hero". I shiat you not. I almost vomited all over Shaghanappi trail.

But I hate headlines filled with half truths. The headline is actually false. If im caught passing a joint nothing will happen. The last time it happend the cop asked me if we had more, we said no, and he said move along.

This law is specifically aimed at grow ops. Not the users.

Not that I agree with it. But that is the truth of the matter.

As for the people biatching about the PM we elected. Tough nuts. The alternatives really really sucked. How is that change Obama promised working out for you?

To the people saying this won't be enforced - THESE ARE MANDATORY SENTENCES. Judges might not like the sentences but they will have to serve them.

Right now they're putting in super strict digital lock laws that make pretty much every Canadian under the age of 80 a criminal for ripping tunes to their iPods, no exceptions even if you own the original media.

Are we getting private prisons too? Oh goodie, I guess the robber barons want themselves lots of slave nice cheap prison labor.

Anybody who votes Conservative deserves a big kick in the face and balls. I spit on you assholes.

You have a very weak understanding of our justice system.

You only serve a mandatory sentance if you are convicted. Judges have a lot more power then you think they do. They can refuse to try a case and throw it out before it even starts.
