It's just really depressing to see how everyone is so quick to jump down her throat and condemn her for ruining her life. It's all "you suck" and "die already, biatch", but she's still a human being and words like that can hurt. Worse, it can drive her further into her addiction.

She's only in her mid 20s. She looks terrible. She needs help and support, not ridicule and condemnation. I'm not trying to get laid by her. I don't even know her. All I know is that I see someone whose life is spiraling out of control and needs to get back on track.

All she had to do was do her community service.

Just remember, this all stems from something happened like 5 years ago. She just can't seem to follow instructions and they just won't put her in jail.

This just getting stupid. Either let the woman serve her sentance or lock her up for the minimum that most defendants get for this kind of thing. I mean dragging her into court over and over again and biatching about 40 min is 'tarded. This is why people biatch about getting stuck in the system. To my knowledge even two dwis in most states, by themselves, carry extended jailtime. Yeah she has the theft conviction, but i mean she would not have had probation issues if the dwis had just been handled.

In a county just east of Atlanta, one of the judges out there would, upon a conviction or a guilty plea on a possession charge, occasionally make as part of the sentence a requirement that the defendant go to the local graveyard, dig a full-sized grave, bury whatever contraband was seized during the arrest, and then fill the hole back up.

And the voters loved him. The defendants--not so much.

The thing is, going through probation and community service is not that hard. All you have to do is stay out of trouble and show up somewhere and try to help out.

She just thinks it's beneath her and is trying to be the cool kid that doesn't care, but she just looks like more of a lowlife.

Seriously, it's 360 hours of community service... you could knock that out in 6-8 weeks and move on with your life.

I don't think it's the court's role to "make it work for her". I think it's her choice to not commit crimes and not agree to terms you feel you are too good to adhere to.

I agree. When I have a client that I know is going to be a problem on probation, I try to negotiate a straight jail sentence on the front end than place them in the inevitable position of repeatedly violating probation. The straight jail plea is often substantially more jail time than they would receive in conjunction with probation but, more often than not--repeat probation violators end up doing more time and spending more money than if they had just taken the straight jail plea in the first place.

Well in my opinion her crimes are relatively minor and Cali cannot afford nor has the space to long-term incarcerate people who they are just mad at, for petty crimes.

Driving drunk, being coked up, and stealing are petty, but it's important to enforce penalties for it.

So how many chances does she get before she quits getting a pass and actually has to be responsible for something? I think she's currently on about her 10th "second-chance" right now. Being lenient on her and trying to give her a chance to turn things around obviously isn't working very well.

The first two, maybe three times messing up can be accepted if it looks like you are genuinely trying to help yourself and the slip ups were minor. But clearly she doesn't care or is so deep in addiction or both to try. Being late is no excuse. If I was ordered to be on time to a court ordered anything I would make sure to show up early! She's not truly making an attempt. I feel bad that she is sick with whatever she has/is addicted to but these aren't reasons not to face the consequences. If she really cared like she says she would put in a lot more effort than she has. I feel for anyone who is afflicted or I'll but that is not a legal free pass unless you are severely mentally ill (in which, theoretically you will still face the consequences once better) or you are on a deathbed.
