It is not like he broke his arm or stole his car. Shave the word out, pay the fool, make the barber do some community service or pay a fine. Jail still seems a bit harsh.

A court of law is unlikely to agree with you. He not only (legally speaking) battered this guy, but he did it under the cover of deception, to a mentally defective victim. I think it is highly unlikely that a judge or jury would ignore the despicable nature of those actions.
I'm not saying they'll send him to jail - but I think the chances are good that he'll do short time.

I know a guy who's very old and can tell tales until the sun comes up. He was once in charge of looking after the mentally handicapped in Alberta. He said they had a six point scale: idiot, imbecile, and moron. Each has low and high grade. Apparently the low grade idiots were just drooling lumps of flesh, while the high grade morons were practically no different than most Floridians. Listening to this man is as close as I'll ever get to actual time travel.
