I'm still curious to see how this "we invented the rectangle with rounded corners" lawsuit is going to pan out.

Yeah, it seems pretty odd that such a thing could be patented.

Are competitors expected to create non-standard size screens with random shaped bezels?

OK, this is only tangentially related, but I just got an iPad and I wanted to share this. If you want to keep porn on your iPad but don't want anyone to find it, buy an app called Tic-Tac-Lock. I believe it's only $1.99 and it looks and operates just like a tic tac toe game, but if you tap the boxes in a pattern you create, it unlocks a secret library.

And Apple claiming they invented the look of the iPad?

How about something that looked exactly the same in 1969?

You should download the Amazon Appstore-- one free paid app every day. It's pretty hit or miss, but the only app I've ever paid for is ClockworkMod's ROM Manager. Have 150-200 other ones, mostly from the Amazon Appstore.

Winning: Are competitors expected to create non-standard size screens with random shaped bezels?

That's the thing-- the Galaxy 10.1 has a 16x9 screen ratio while the iPad has a 4:3 ratio. They're different.

/rounded corners?
//never had a device with sharp corners
///they have a patent on the radius of their corners or what?

Do you have a clip that shows it being picked up and manipulated in 3D? If not, it's not "exactly the same". The one in your clip could be (and actually was) a CRT embedded in a table, and is therefore not anticipatory of the patent application.

My secret library of porn is called the internet. I don't have to tap any boxes to hide what's there.

I suppose your application would be useful for people storing child porn, but frankly, I'm not sure why you want to advertise that. Incidentally, was that a knock at your door?

Why don't the lawyers for Samsung set up a macbook and a laptop and show how similar they look. Or two desktops and show how similar they look? I could see if the were getting into the similarities in function or applications but on how they look? Seems kind of silly to me.

How about Star Trek PADDs? There were hundreds of those used in the various series and movies decades before the iPad was patented.

Different, though.

One thing to bear in mind is that this is about a design patent, not a utility patent... Design patents are much narrower. You kinda have to work to infringe a design patent.

And that's all irrelevant to a design patent.

ridiculous characterization. They're not claiming they invented rounded rectangles. They're claiming they invented rounded rectangles of any aspect ratio between 3" and 16" on the diagonal.

Check out this article. Design patents are really, really narrow. Samsung would have had an easier time not infringing this patent than they did infringing it... but then they couldn't capitalize on the market advantage of having a look-alike counterfeit.

Theaetetus: And that's all irrelevant to a design patent.

Here are the two devices side by side. While similar in that they both have a black bezel and rounded corners, they are different in several ways:

1. Display ratio-- iPad is 4:3 while the Galaxy 10.1 is 16:9
2. Bezel size- iPad has a significantly thicker bezel.
3. Camera- The Galaxy 10.1 has a front-mounted camera for video conferencing/camsex.

Similar isn't illegal. Nobody is buying a Galaxy 10.1 thinking it's an iPad, they know what they're buying. (A better device.)

Um, nope. Go look at the tablet roundups from CES 2010, several weeks before apple showed the iPad.

Several had very similar designs to what apple would show a month later.

The galaxy is a pretty different aspect ratio. like 12% different. Like 12% better for video different. Apple attempting to extend their claim over a design consideration clearly emphasized in another design and presumably eschewed by their own... well, it's somewhere on the cunning/foolish spectrum of the corporate venn diagram

Prior art and patents do not work that way.

Though actually a CRT hidden in the table it was clearly meant to be a thin, portable, device.
That qualifies as prior art.

This reminds me of an old picture (which I am sad to admit I can't find) of the black and white side profiles of about 15 mid-1990's midsize sedans. I could pick out maybe 3, and I knew my cars.

When form follows function, sometimes everything starts to look the same. Apple is just the first major, publicly watched company to have a business model that depends on lawsuits over intuitive design features. And for that, they suck.

AlsoTheShavingofOccam123: oh. i thought AdFree didn't require rooting. I see.

Yeah, and the people that install AdFree weren't going to click your ad in the first place. The other 90% of users have no idea what an adblocker is, much less how to install or configure one.

Koh frequently remarked on the similarity between each company's tablets. At one point during the hearing, she held one black glass tablet in each hand above her head, and asked Sullivan if she could identify which company produced which.

I wonder if I asked a judge to identify Javascript on one monitor and Java on the other they would be able to do so. And I severely doubt anyone in the entirety of the computer science world would claim that such had the slightest meaning in any sense other than "you're a farking retarded law school douche weasel."

Law school douche weasels have no business interpreting product design as "unique" or not.
