You can see how Congress thinks with emotion vs. reason by looking at the list of possible sentences on each count. Trying to destroy the airplane: Maximum 20 years. Using a bomb in the process: Minimum 30 years.

FTA: "blessed weapon to save the lives of innocent Muslims."

Two things:

1) IF it was a 'blessed' weapon, it probably would've, I don't know, actually worked.

2) How many innocents on that plane were Muslims just trying to catch a flight? Bet you didn't think about that did ya Mr. Explody-Pants?

I don't think it makes a difference in this case. One law school professor who specializes in sentencing policy agrees.
