This.

The chief may want to fire his ass and never look back but if it isn't shown he followed procedures set in place by the unions regarding disciplinary procedures, it would the chief's ass on the line.

Why? Because here, people follow up on that kind of thing.

A Winooski police officer is accused of driving drunk, at more than four times the legal limit, on Interstate 89 during rush hour.
Police say Nokes' blood alcohol contents was .332. He was processed for suspicion of drunk driving.
He is a 15 year veteran with the force. Chief Steve McQueen has placed Nokes on paid sick leave.

Please explain why this is reasonable and he has not had to post bond for reckless endangerment, anyone who would like to comment on this matter?

2011-08-07 09:12:15 PM
If he actually is an alcoholic, then actually is sick, as much as people who've never been (and like 1% of loudmouths who were, or at least said that was why they beat her and they'll totally go to rehab no matter how 'hard' it is) love to debate that. With that said, and as OutsmartBullet said, at the end of the investigation that may very well be a reason not to be employed in an incredibly high stress field any longer.

And with *that* said, there is absolutely no excusable reason that the article doesn't end with, "Currently out on X Bail" just like it would for pretty much anyone else.

This is actually not that abnormal. In my state alcohol addiction is considered a medical problem and my employer would allow me to use accrued sick leave for treatment if I requested it. A BAC of .332, in the middle of the afternoon and probably after an hour of waiting for the blood draw, indicates several alcoholism or a suicide attempt. Before the cop bashing really gets out of control consider that the article mentions he WAS processed for DUI and will be facing charges the same as anyone else.

You are telling me that someone that test 3 to 4 times over the limit during rush hour traffic would only get a DUI charge.

I think a legitimate reckless endangerment charge could be added and probably should be. As we all know, being intoxicated is not a valid excuse for bad behavior in the eyes of the law.

You have been crusing fark too long.

complacent cops are as bad as corrupt ones.

you expect me to believe union guidelines supercede rule of law?

one law for them, one law for us.

it's time to start anew, and it's not going to be pretty. it's unfortunate it will come to this and i hope i don't live to see it, but sadly i'm thinking i just might.

Someone must have seen him get stopped (or saw him driving erratically before it happened).

Most cases I've heard of like this the guy gets sobered up at the station, driven home, and their hand seriously slapped with a ruler, but nobody ever knows.

I'm surprised it even reached the point of being reported and action having to be taken.

I, for one, am glad to know that the police in Winooski recognize that alcoholism is a disease that needs treatment rather than punishment and welcome their progressive approach to DUIs. I look forward to seeing the result of the implementation of this new official policy to all DUIs in the area.

If it can be bested by willpower alone, and isn't solved by white blood cells, it isn't a disease.

Happened in my parents county a few times.

The sheriff there used to sell off "seized" items at auction to his deputies for a few hundred bucks. The one that got him tossed from office was a Sgt buying a "drug seized" skiboat (worth 25k) for $500 at "auction." They checked into it and it never made it to the auction yard.

After that was discovered some digging was done and a few DUIs were covered up. A few for deputies, and one for a member of the County Board of supervisors. There were a lot of sales of "seized" items to his friends and deputies. Another classic one was a new Crown Vic that got "totaled" after 1500 miles on the clock. Suddenly his son has a new engine in his Crown Vic he bought used for a few hundred bucks. That one the county didn't even get a dime for, they just scrapped the car after collecting the insurance money, sans engine, I guess the insurance company didn't check.

Grand Jury indicted him, but they dropped it on the agreement he resigned. An assistant district attorney was in his pocket too allegedly and would help his buddies get out of stuff. He resigned and left even though it was reported later they didn't have enough evidence on him to indict him.

This was about 15 years ago though. But to say it never happened....come on. Small town/city/rural counties have stuff like this going on all the time.

The person that broke the story was on their s-list though, got stopped a lot and harassed. Not very smart to do that to a reporter for the local newspaper everyone reads.

But it DOES happen. Maybe not as much now, but knowing certain people in law enforcement in small communities does help. And there is a reason why cops who barely cut the mustard will go to small counties to work.

To say that the good buddy system doesn't exist is BS.

Hey, it's actually more punitive than most of the time. He's having to use up his accrued sick leave instead of a normal suspension with pay, which wouldn't detract from his vacation, sick, or comp accruals.

Yeah, I know, not exactly a good situation. But, on the other hand, maybe a grand jury or a state prosecutor will decide that this is worth making an example of, given how drunk he was compared to the treatment he's received.

Derp on the typo, I meant severe of course. Enemabag I seem to have irritated you, but I can tell you that in this state the majority of DUI arrests are released after processing on personal recognizance. If you are a really drunk, like .332 you are going to stay in the hospital because the jail won't take you.
