There's a chance the ex could be guilty of DUI. Conspiracy to commit a crime, soliciting a crime, and aiding and abetting a crime all make one criminally liable. Prosecutors don't normally charge traffic offenses due to lack of evidence of intent and because they are so minor.

IANAL but I don't see how this is entrapment. Entrapment usually involves something that the subject wouldn't ordinarily do. This guy found the girl on Match.com, chose to meet her twice, chose to drink w/her, and chose to get into the car. Nobody forced him to drive drunk--he thought w/his dick & started driving to what he thought was a threesome in a hot tub.

Besides, the police were acting from a tip--a tip from the lawyer the guy's wife hired to screw him over. It's a slimy thing to do & his ex is a total biatch but I can't see how what she & the lawyer did was illegal.

Even if this were otherwise entrapment, the defense of entrapment applies when the government pushes you into the trap. Without government action it's just a girl talking you into doing something you'll regret later. But Bar Girl does not have immunity from prosecution like a law enforcement officer baiting a trap. If she is trying to get you to be criminally drunk in public, she is guilty of accessory before the fact or soliciting a crime.

If you're in the middle of a divorce, and you're drunk, you should call a cab.
You should also call a cab if you are drunk and not in the middle of a divorce.

In fact, the two times when it's most important that you should definitely avoid driving drunk are (1) when you are getting divorced and (2) when you are not getting divorced.

If you are either currently getting divorced or not currently getting divorced, you should avoid driving drunk.

Stick to those two rules and you'll probably be OK.
