The law, Georgia Code 40-6-393(c), reads

Any person who causes the death of another person, without an intention to do so, by violating any provision of this title other than subsection (a) of Code Section 40-6-163, subsection (b) of Code Section 40-6-270, Code Section 40-6-390 or 40-6-391, or subsection (a) of Code Section 40-6-395 commits the offense of homicide by vehicle in the second degree when such violation is the cause of said death and, upon conviction thereof, shall be punished as provided in Code Section 17-10-3.
Section 17-10-3 says the judge can lock her up for up to a year, fine her, or suspend her driver's license; this is the general rule for misdemeanor traffic violations from speeding up to homicide.

The photo caption reads: "No marked crossings are visible in the photo." The lack of marked crossings is a good thing. A study found that marking crosswalks on four lane roads with traffic over 35 mph made the road more dangerous. Drivers aren't expecting pedestrians to cross those roads. Crosswalks make pedestrians feel safe when they aren't.

Bus service should be designed so people don't have to cross major roads except at traffic signals.

That's right: Because Nelson did not lug her exhausted little ones three-tenths of a mile from the bus stop to a traffic signal in order to cross five lanes of traffic, she is guilty of vehicular homicide.

She shouldn't be put in jail, but she should walk .3 miles everyday to remind herself what a big deal .3 of a mile is compared to the safety of your three children. You have little kids? Use the goddamn farking crosswalk when you're crossing a 5 lane highway.

Everything about this story sucks.

considering her child was dead after attempting to jaywalk, it would appear that at least in this instance, not using a crosswalk was enough for her child to be killed.

The traffic light is the only safe place to cross a road like that.

Nail the drunk driver (he shouldn't have been on the road), but mom was definitely negligent.

/tragedies are usually the result of multiple smaller mistakes.

It was 3/10 of a mile away. A 5 minute walk. Would you rather bus stops be right next to crosswalks so that drivers attempting to make right turns at intersections will have their views blocked by buses?

Years ago I was a single mother with 1 child, often taking the bus carrying groceries and a tired kid.

If you would actually read the article, you would notice that there is a photo of the area where it took place, and you would also notice that there is no farking crosswalk to use. Putting a bus stop in a location that's not near a traffic signal or crosswalk is farking stupid. But, only poor people ride the bus, and who gives a fark about them?

More pedestrians die in crosswalks than anywhere else on the road as well... wonder why that is?

The problem here isn't that the mother got charged. She should have. But the drunk driver pled out to reduced charges and will serve less time than Mom.

There are a lot of streets like this in Atlanta. Playing dodge the pedestrian is a local sport.
