Shouldn't there be a "said," "accused," "claimed," "allegedly," or something of the like in there? Or is it libelous headline Saturday again?

While the bill was making its way through Congress, another woman got a payoff through arbitration. Senator Franken made sure that will not happen again. He must like rape.

She got free marketed.

Jones said the civil trial wasn't a fair fight. She said she felt she lost because the jury wasn't allowed to hear details of her attacker's past but were allowed to hear hers

wait - so the defendant is allowed to call his accuser a slut, but the (alleged) victim isn't permitted to show physical evidence after the incident? how is that even fair?

*sigh*

right. money talks. KBR covers up a rape, gets caught in the coverup and then finds a jury that thinks rape is what people do to pass an otherwise slow friday night at the corner bar.

Bolen, the KBR spokeswoman, said the "outcome of this jury trial as judged by her peers is the same result that the State Department got in 2005; that the Justice Department found in 2008. We are deeply gratified that the justice system has worked."

I.e. those we paid off stayed bought.

Is this a metaphor for supply-side economics?

Jones, who had been a clerical worker in Baghdad's Green Zone, testified that she was drugged and then raped by a group of KBR firefighters. She said Bortz was in her room the next morning. During four days on the stand, she told jurors she has no memory of what happened ...

Bortz's attorney tried to show that after the alleged rape, Jones did not appear to act like she had been attacked but instead went to work as normal, joked around and talked about camp gossip.

and had to have reconstructive surgery for her breasts, which were disfigured in her attack.

Smelled like bullshiat last year and still does...

Good thing that's settled.

I don't think she was. Nowhere in anyone's testimony did a pinball machine come up.

More likely that she got drunk with them, farked them all and regretted it once the booze wore off.

or maybe she was raped and KBR helped cover it up. we'll probably never know for sure.

that said, the mandatory arbitration thing is f*cking bullshiat. i'm glad that got shredded.

I have my doubts about that.

Yeah, and then had reconstructive surgery on her breasts because of the fun time they were having whilst drunk... Idiot.

If you agree with this decision you cannot be upset about Casey Anthony being found not guilty. Circumstantial evidence: how does it work?

They should have taken her out on a boat instead.

Because of the implication.

Good. The last thing we need is another frivolous lawsuit bogging down the court system. If only coffee crotch woman would have had this judge.

Different burden of proving. I am very confident of the Casey Anthony case passing the burden of being beyond the preponderance of the evidential information and maybe even the clear and the convincing standard but not for the beyond the reasonable doubt. So you are making the comparison of Fark.com members to those who are skinny.

2011-07-09 07:12:51 PM
When in a country where women are treated as subservient property, do not make the mistake of thinking that men will not act in such a way towards you, even if they were born and raised in a country which does not condone such behavior.

I'm sorry, but just because you claim "rape" doesn't automatically mean that you're telling the truth, or that you deserve money. People can and do lie about rape; we've see it again and again and again. It sounds like she does have a history of dishonesty, and like it or not, that DOES matter when it comes to determining if somebody is telling the truth. Lie too much, and people won't believe you anymore.

There's this idea that we must believe everyone who claims rape, and convict people, despite zero evidence, even in cases where there is serious doubt. That's not how our justice (!) system works. As horrible as it would be, I would rather a rapist go free, than imprison an innocent man. In this case, it's clear that there were serious problems with her story, the evidence did not convince a jury, and for once I think they made the right call. Unfortunately, people love to play the "innocent woman victim of big, bad, business" angle, regardless of what the truth might be. However, I can't help but remember high profile cases like the stripper who falsely claimed to have been raped by those Duke guys, and the trial-by-media they underwent. Even when they were shown to have been innocent, their lives were still more or less destroyed. I would hate to see that happen again.

Due in part to Jones' case, federal lawmakers in 2009 approved a measure prohibiting contractors and subcontractors that receive $1 million in funds from the Department of Defense from requiring employees to resolve sexual assault allegations and other claims through arbitration.

So companies that get $999,999.99 or $1,000,000.01 from the DoD are off the hook then?

Considering the security company was trusted with the results of the rape kit and having it disappear for 2 years kinda makes me very suspicious of the company. If she wasn't raped, why in the hell did the company hide the results?

it is rather interesting to see our usual right wing shills show up and defend KBR on this one. I wonder how the hive mind coordinates? its it some kind of electical signal? pheremones? chemical signatures?

well..no. there are holes in her story, sure. But was that due to KBR juggling things around a bit, or was it due to lying from the defendant? thats something that is less clear. Not to mention that KBR sure seemed to be acting guilty the whole time.

ah well. odds are we'll probably never know what really happened. But I think I'd be less inclined to work for KBR after this story.
