(C) An officer/agent, or employee of a library, museum, or archival institution pursuant to division (B) of this section or a merchant or his employee or agent pursuant to division (A) of this section may detain another person for any of the following purposes:

(2) To cause an arrest to be made by a peace officer;
(3) To obtain a warrant of arrest.

I think you're remembering what Consumerist has said (correctly) about the fact that stores can't make you show them your receipt on the way out. They can ask you, but they can't make you, because walking away from the cash register area towards the front door does not satisfy the element of reasonable suspicion contained in the shoplifting law.

They absolutely can. As far as I know all fifty states have shopkeeoers privilege, which allows a merchant or his agent to detain a person if they have reasonable belief that person is engagesd in retail theft. They must use by law the minimum amount of force necessary.

Now a compAnY LIKE Walmart can have a policy of "hands off" if it wants, but Walmart still maintains their hands on policy.

We can only recommend they put the items back and threaten to call the police. That is a total joke in our city, and the shoplifters know it, because the cop will show up two hours later, if at all. If they make it to the front door and cross the threshold into the parking lot, we let it go man, cause it's gone. So basically, you could walk into our store, blatantly remove an item form the shelf and walk out past the beeping security towers and we wont do a damn thing about it. And yet, the shrink for our store is amazingly low. There are still more honest people in our town than dishonest I guess. That being said, I really hate teenage girls and their "Jersey Shore" attitudes when they are in the store.

Unlikely. The Guy your thinking about is not directly hired by Walmart, he's a third party. I believe Wally has that contract through US security associates.

The LP guys are much younger and slightly better paid.

I've actually heard pretty good things about walmarts LP - makes sense they do, as being the largest retailer brings with it a lot of risk.

To clarify I've heard good things as compared to their previous image... which was all about fighting.
