Ohhh...

The state should have offered to go in at least halfsies on movable basketball nets with these people. The kind on wheels, that can be moved away from the curb to accommodate the public safety issue. This looks more like a "battle of the dicks" here to see who can be more intransigent and uncooperative. This is what happens when jack-booted thugs run up against Neanderthal me-firsters.

I worked for a city in CT and the cops made us remove hoops from the street, I didn't like it, but it was the law.
Cool story, bro: we removed a hoop and the neighbors crowded around the workers threatening them. The cops stepped in. Two days later the same people assaulted two cops.

If there actually is a statute for snow removal or something and there was notice, okay, MAYBE I could see sending the trucks. But KEEPING THE POLE? WTF? There's no legal way they should be able to do that, ESPECIALLY since the woman from the DOT told the guy he could keep his pole on tape. That woman totally needs to get ass cancer.

If you think my post was merely to respond to the events in the video then perhaps you should read my post, starting at the word "bocanegra".

This was clearly a failure of govt. officials to deal appropriately with citizens during enforcement (lying and threatening arrest should not be done so casually), but breaking it down to a liberal/conservative issue or generalizing that governments shouldn't intervene when private citizens disagree with "the will of the state" is disingenuous and silly.

As far as the ordinance underlying the enforcement, as you point out there isn't enough information available to really judge that situation, but to address the concerns you raised...

If the DOT has a "no hoops on the street" ordinance, it doesn't matter how long the hoop has been there, its in violation. Grandfather provisions are not an automatic part of every regulation.

A hoop might not be as much of a safety issue on a cul-de-sac, but when you start making exceptions based on circumstances you need procedures and criteria to adjudge those exceptions fairly, and those have their own costs (large scale bureaucracy). In any case, its not in the discretion of anyone in this video to consider the relative safety of the hoop in question.

Also, if the rule is motivated by liability exposure, then the relative risk is completely irrelevant. Whether the hoop is on a through street or a cul-de-sac, if the city allows an attractive nuisance on public property they could be liable for injuries that occur there.

Liberal/conservative/farktard, use whatever label you want, but this was clearly abuse of power. You might say it's an isolated incident, and this one person screwed up and needs to be counselled/fired/put in her place/etc, but there have been a lot of "isolated instances" and "one single employee" stories lately, and I think this is happening no matter what flavor of government is in charge at the moment.

We really need to stop saying Land of the Free lest we be sued for false advertising.

Actually, I think it should be rather simple:

DelDOT should maintain solely those roads that fall under the purview of DelDOT.

It is highly unlikely that a cul-de-sac that wouldn't in an a sane world have a state route designation should be under the purview of DelDOT.

Now, if that causes a problem for snow-clearing service, then the HOA should handle contracting out for that. If there's no HOA, then one should figure it out with the other neighbors. This comes down to, yet again, expecting government to provide too much. When government provides basic services, they expect to be able to make rules too. If they don't provide the services, they have less power to create rules.

The answer here to that group of homes is to TAKE THE ROAD PRIVATE!

I don't even have kids but I let the neighborhood kids put a basketball goal up on my front lawn because it was closer to the dead end. What do I care about a minor cosmetic blemish that causes others to enjoy themselves a bit more?
