Why is this guy going to prison? He was at his apartment and the other guy came over with a knife.

Is the court saying he provoked the incident somehow? Accidentally calling someone a nutter (or even purposefully calling someone a nutter) doesn't really seem like a legitimate provocation for someone going to your house to attack you with a knife.

I want to know why the judge thinks the sentence will be a long one.

The other guy came at him (bro) with a knife, I realize 104 is a bit excessive, but the first 10 or so would be justified.

Self-defense would be disarming the man. Now that you have his knife and he has nothing, you don't proceed further with your (counter)attack.

The problem I have with this is Witkowski went to Brook's house with a knife. He was the aggressor, the guy charged is the one who was at home and ended up defending himself. Sure 104 separate injuries sounds bad, however some of those could have been fairly minor and the result of trying to get the knife away from the psychopath that came over with the knife. Having been in schoolyard scuffles in my past I know that it is not difficult to get tons of "separate injuries" just from rolling around on rocks and what not.

If it takes you more than 3 or 4 cuts to kill someone, you're doing it wrong. (Shouldn't take you more than one, but it's good to have backups.)

If you follow the link at the bottom of the article to read more about the event then you have a better understanding of why the guy was charged:

1. 'A' sends 'B' text
2. 'B' gets knife comes over to 'A's place
3. 'A' has a knife of his own and stabs 'B' in the leg
4. 'B' tries to take shelter in the bathroom
5. 'A' continues to attack 'B'
6. 'B' sustains 104 injuries including cuts, stab wounds, bruises, and slices on his hands
7. 'B' dies from fatal stab wound to the heart

No, that's completely wrong. Self defense is not necessarily the most ninja like move you saw on TV. Disarming someone with a knife? Not necessarily something you can do. If someone tries to attack you with a knife, they just tried to murder you, and you should kill them. That's the minimum amount of force you should use, unless they actually retreat (which happened in this case, apparently).

It's not clear to me that these 100+ injuries count as 100+ attacks. A lot of little cuts and bruises may come from just a few attacks, or a scuffle, or even a panic. I am not hopeful this is legitimate justice, since we're dealing with a society that looked down on any self defense, especially with a weapon.

Anyway, if you have a weapon and someone is attacking you with a knife, don't try to be Steven Seagal. You probably can't disarm them without risking death.

Yeah, I have a cat named coal. I almost replied to a friend who asked what I was doing that I was "outside looking for anal." Another one of the suggestions was "cock".
