Lets see stupid kid does'nt pay, jumps off train to avoid being caught. Father sues.
They should sue the father for being stupid. Why not they can justify it. It runs in the family.

But Gavin's father, Phillip Austerberry, said MTrain had admitted its guilt by sacking one inspector and demoting two others.

As a result, he said he would take legal action against MTrain once Gavin recovered.

Yeah!! They should fire that ticket inspector cause he didn't fire a machine gun into the stupid kid as he jumped off the train! That would of learned him!

Of course the kid is a dumb ass, but when an adult watches a kid jump off a train under any circumstances they should call for some help. Or do you really believe that dumb teenagers deserve the death penalty for being dumb teenagers?

um - I think you're all missing the point. The reason the ticket collectors got in trouble for not calling the authorities was that had they made the call then someone could have provided emergency services to go pick his unconscious dumbass up and provide medical attention, which he obviously needed. Instead, they just went on about their job, ignoring the fact that this kid was now lying somewhere down the tracks and hurt.

We had something like this happen in Boston about a year ago - train crew is required to call authorities (e.g., emergency personel) when someone on (or recently on) the train may have been hurt.

...and you'd be surprised how often people commit stupid stunts in, on, around, and under trains.

GoodCopBadCop - In a word: "Yes". If some idiot (teenager or otherwise) jumps off a train, they deserve any injuries that they get as a result. The pain that the kid's now feeling is nature's way of telling him he's a moron. If he had died, it would have been no one's fault but his own.

clarkcox3 -- Of course the pain he is feeling is his fault. And nothing in my post suggests that I believe the railway should be liable to him for his injuries. But I do believe that railway employees who are too stupid to report the fact that somebody fell/jumped off the train deserve to be sacked.

Or are you advocating some sort of a system where we first determine whether somebody acted stupidly before we render assistance? Do we then only render assistance to people who are injured through no fault of their own?

The rail company is within its rights firing the ticket inspector for not following regulations, but there is no way this a**hats family should get one cent. The kid jumped from the train and was not pushed or tripped out of it. Perhaps the state should sue the family for not keeping an eye on a suicidal underaged minor.
