I'm curious, why is the "ignorance of her age isn't a valid defense" thing okay? Because it seems to me that it should matter.

That being said, the thing that the DA seemed intent on punishing was the fact that LT was soliciting a prostitute - illegal regardless of age. The fact that LT helped the prosecution on some other sex trafficking matters is probably THE thing that gets him out of any jail time.

I agree with you. But when it comes to staturary it seems it often comes down to "she said she was 18". Personally I think we should legalize the prostition industry and strictly regulate it. If you work outside or patronize outside of the established boundaries you should be crucified by the legal system. It would help insure the girls make the decision of their own volition and are better protected. I realize there is no perfect solution but i Believe that would help. *Comrade Bingo has never used the services of a prostitute*

you remember correctly.

but others need to also remember, the USA loves it's football. We forgive anything for a present football hero. If you study the history of football, you would realize that he is one of the all time greats. He reshaped football by himself. When he came into the NFL they realized what devastation a defensive end could reek. So they got faster and stronger defensive ends and line backers. Which brought about the super left offensive tackles, who are paid almost as much as a quarterbacks.
He with his talent and maybe a few drugs did this. I can't think of a single football player who has reshaped the game of football as much as he has since the advent of passing.

How about proceeding with caution? He's with a prostitute, probably not the most trustworthy person. She needs money and will do or say anything to make it. Anybody with a brain would have thought, "Hmmmm....wonder if this girl is really 19. Maybe I should tread carefully". But then again, that's me, and I don't hire prostitutes.

When I turned 25 I decided "if I have to ask, I needn't bother" when it comes to the girls age.

That said, I had dated girls that could pass for much older when I was 17 or so. I've also seen 20 year olds that could sneak back into a junior high without suspicion.

What's he supposed to do? I don't know, maybe not get cracked out, call for a prostitute that apparently looked young enough for him to feel it was necessary to ask her age and then have sex with her inspite of the fact that her pimp delivered her to his hotel room freshly beaten up? If a pawn shop owner buys an item that ends up being stolen, he doesn't go to jail. He was defrauded. Technically, he has received and dealt in stolen goods, but charges are not brought unless there is proof he was aware of the situation. Under contact law, people who are defrauded are typically held harmless. Also, one must be 18 years of age to enter into a contract. If it is found that one party was not 18-years of age, the contract is almost always null and void.

When it comes to sex, its no different. An individual who misrepresents his or her age has committed a civil violation at minimal, and arguably a crime, when looked at consistently under the law.

Say what you want abouit LT here, ordering a hooker and what not. But his situation happens all of the time. Courts have acted ridiculous. There's even been cases of underage girls being in 21+ bars and guys still being charged and convicted for sex crimes. Its ridiculous. We have a lomng way to come still with are hang-ups about sex in this country.

Statutory rape is a strict liability crime, which means that there is no mental state required to be found guilty. Normally for criminal liability to attach, there must be a criminal act with a concurrent mental state, which have varying degrees.

That being said, statutory rape is a fairly archaic law. At common law, it only applied to female victims under the rationale that girls cannot take care of themselves, but boys can. We can't always equate justice with fairness.

Ok, lets say i'm at a football game, and am approached by a good looking girl who looks to be 19-20, says she's 19-20, says she's in college and majoring in whatever, etc.

We have sex, she turns out to be only 16.

JHow is there any criminal intent there? There isn't.

The law is dumb.

It doesn't just apply to solicited underage prostitutes, it applies to any girl who misrepresents her age to get a guy.

It's ridiculous.
