I have a friend who claims to have mistakenly slept with a man into woman transformer.

He said her vagina smelled kinda like balls. Whether or not thats an improvement over smelling like vagina is unclear.

you can make an argument that it is morally wrong to fire someone without cause or without giving them a chance to correct a mistake but the doctrine of assuming all employment is "at will" unless explicitly stated otherwise is without moral value, good or bad.

Thank you. I'm feeling good and nice today. Some days though, I chuck that grace off to the side and jump down into the gutter to fight. It's just something I had to learn how to do to survive. When using it as an insult it may as well be, although people like TVs seem to like using the word freely. The N word I know does get used amongst a community of sorts but that isn't really the same thing somehow. I can't find the words to describe that though.

I confess I haven't read all 315 comments in this thread (I have better things to do, fellow farkers), but it appears that no one knows the difference between a transgendered person and a transexual person.

Transgendered people generally, and genuinely, feel that their socially assigned gender is incorrect. Example: A biologically male person feels that her culturally assigned gender ("man") is in correct and would like to be known as a woman.

Yeesh. Talking about not comprehending the subject at hand.

1) The goal of default contract terms is to create a rule to guide courts in the event of dispute when the parties have failed to specify terms in their contract. The most sensible way to decide default contract terms is to ask "what term would most people prefer in the absence of actual agreement?" While most employers would prefer the at will model, most employees would prefer the cause model. Employees outnumber employers, ergo, the default model should be for cause. Would most people prefer a contract term which prohibits them from leaving employment except for cause? Certainly not. Such a clause is therefore not sensibly part of default contract terms.

2) Under cause rules, nobody is forced to associate. Make cause the default law of your state, and employers know when they hire someone what the default terms are. If employers want to bargain for a less restrictive employment contract, they're free to do so. Just state in the job description that the employment has no job security, and that the employer retains the right to fire the employee for arbitrary, unjust, or discriminatory reasons, except discrimination against classes protected by law, and the employer retains all the power of an at will contract.

3) In cause jurisdictions, employees do not have a right to a job. They have a right not to be fired for arbitrary or unjust reasons. If the employee in your example is unpopular because he listens to different music than most of the employees, or prefers a different sports team, but isn't disrupting the workplace, there is no reason he should be fired. And if he's genuinely causing a disruption, and he's not being victimized because of some prejudice towards his peculiarity, the employer has cause and can fire him anyway.

Not completely true... If the company substantially alters the work agreement you can quit and still be eligible for UI.

I once worked in sales for a company that decided to get rid of our $20k base in exchange for a higher commission rate, but there was no way that the higher commission rate was going to come close to filling in that $20K gap. (not to mention the fact that it's not guaranteed income like a base salary is)

Anyway, I filed and received UI as a result, over the protests of the company... who claimed that I quit. We had to have a hearing, but I won.

You've got to reject the modification to the work agreement immediately though... If you work for a week under the new conditions and then decide "fark this," it's considered just plain old quitting, because the time you worked under the new agreement is viewed as tacit acceptance of the modification.
