We was aware of it? Doesn't sound like a good tort defense.

They should have put the pool in another area of the hotel. While that's too late now, I guess they could put a giant tarp over the pool area to try to fix the problem.

If only there were some way they could have predicted this. Perhaps if there had been some kind of installation in the nearby desert that utilized this "death ray" to generate electrical energy for casinos.

Either lawyer is exaggerating or hotel that was aware it could be 15-20 degrees hotter was negligent and should either close the pool or map out where the "death ray" is hitting at the moment (move traffic cones every hour or so).

I'm gonna go with the lawyer is exaggerating.

It was probably intended to work that way, but they didn't realize how hot it would make the pool in the summer.

He's not the only victim. In the other stories people have reported heat a lot more than 20 degrees more, including melting plastic.

Well, so much for the solar-heated pool idea. Back to the old drawing board.

Twenty degrees on top of the regular temperature outdoors in Las Vegas? Maybe they could turn the pool into a corn boiler. With a few small modifications, they might have a solar-power plant.

I imagine it was the UHV and not the heat that was burning people. There are days in Canada where 10 minutes in the Sun is all it's safe for a light-complected person like myself to risk. You can imagine the difference being in Las Vegas makes to the angle of incidence of the Sun. This hotel would be harmless in Inuvik.

The Vdara doesn't have a casino, it's about half condos, and half smoke free non gaming hotel. The Aria right across from it in the City Center however will be happy to take your money.
