This is good news, but I don't expect it to change anything on the ground. I don't think a judge in CA can make the military change, it needs Obama and Congress to step up and protect equal rights, which both have so far failed at.

The Act prevents servicemembers from openly joining organizations such as the plaintiff in this lawsuit that seek to change the military's policy on gay and lesbian servicemembers; in other words, it prevents them from petitioning the Government for redress of grievances. John Doe, for example, feared retaliation and dismissal if he joined the Log Cabin Republicans under his true name or testified during trial; thus, he was forced to use a pseudonym and to forgo testifying during trial.

Furthermore, as discussed above, the Act punishes servicemembers with discharge for writing a private letter, in a foreign language, to a person of the same sex with whom they shared an intimate relationship before volunteering for military service. It subjects them to discharge for writing private e-mail messages, in a manner otherwise approved, to friends or family members, if those communications might lead the (unauthorized) reader to discern the writer's sexual orientation. These consequences demonstrate that the Act's restrictions on speech are broader than reasonably necessary to protect the Government's interest.

When I was an NCO I had to watch over my troops for all manner of things.

Underage drinking, drunk driving, staying in shape, can they hit what they aim at with a rifle, making sure they were working towards promotions.

Whether they had gotten their car fixed or if I needed to drive to their house off base just to drive them back on base to work. Try to work them through their wife cheating on them.

Trying to keep them on base so they couldn't go off base to marry that girl they met in a bar whose language they didn't speak.

Making sure that the docs in the hospital are doing their job (messed that one up, he got a medical discharge). Making sure they knew the proper way to put on a condom so they don't catch something (fun fact, about half didn't know to pinch the tip).

Basically, if one of my Marines was gay, and he didn't make me worry about any of the above, I'd be proud to keep him supplied with all the condoms and astroglide he could use. To the average sergeant, what your men did with their private parts was WAY, WAY, WAY down the list of things that concerned you.
