I'm normally not an advocate of lawsuits, especially by prison inmates, however...

His request seems rather reasonable in lieu of the fact that the physician was more then just a bit negligent when treating this man's injury. 10K plus 3700 for attourney's fees for 14 years of potentially life threatening complications? Pay the man his money already- don't even let it hit the courtroom.

Of course maybe Farkers would prefer the alternative which involves a physician (and possibly an entire hospital system) spending hundred's of thousands defending their good name should the law suit go public (may be too late folks). I've seen far less cut and dry cases where the hospital ends up settling out of court for amounts far more then this guy could ever imagine.

You realise you may be advocating a "cruel and unusual punishment" that could result in death on another human being who may have done nothing more then having been seen pissing off his porch in a drunken stupor, had just turned 18 and had sex with his "underaged" girlfriend or had a complaint filed by his neighbor for skinny-dipping in his parents hottub. These are just a few of the 'horrendous' crimes against humanity that can earn you a rating of "sex offender".

There is nothing in this article, other then "failing to register" on the State's offender list that would suggest he was even actively out there being all rapey and molesty on the populace.

They can get you on the sex offender registry, sure, but they cannot get you on the sex offender registry plus 14 years of jail time.

So we're probably talking about felony sexual assault, date rape, or something in that league.

Pretty easy to find out. A quick search of the Nebraska Sex Offender database shows that he was convicted in '97 and the victim was a minor.

That being said - he hasn't been in prison for 14 years. If his conviction for the original crime was in 1997, over a year after his injury, and according to the article he's in prison for a registry violation, that means he served his time, was released, and then went BACK to prison.

First, isn't there a statute of limitations? I do not care if it has been 14 or 16 yaars that seemx like a long time to sue someone.

Yeah. It sounds like a sound case. The Asinine tag isn't warranted at all. Prisoners should get reasonable medical treatment.

While I don't like them, either, the problem is all too often the courts are the only recourse a prisoner has against mistreatment. You see cases over total trivialities because there's nothing else they can do about harassment by the jailers.

SOL varies based on state and type of case. Some states date SOL from the time when you discovered the injury or when you could have resonably been expected to. I don't know in this case.

I need to know his attorneys name so I can hire him to sue the doctor that mis-managed my mothers prescription drugs to the point where she became dependent on Vicodin at 79 years of age. No lawyer in Texas will touch it due to our 'insurance company friendly laws' that are mentioned in the turn down letters I get.

Seems ok to me... I'd assign percentages, probably 90% of the fault lies with the guy for punching the window, the other 10 with the facility and the doctor, then I'd put that money in a secured trust, inform the victim of the windfall of the offender, and give them at least 180 days more to file a suit for damages of his crime.

The article says he *is* in prison, something about violating a sex offender registration requirement, which implies that he was out of prison, possibly for many years.

Here in Texas, when a doctor is deemed too dangerous to be allowed to treat patients, some have gotten exceptions specifically limiting them to treating inmates, presumably on the grounds that they are sub-human. Luckily, it turns out a lot of the people we have been sending to prison, didn't actually commit a crime, so eventually - a couple years, a couple decades - they are freed, and can obtain whatever free-market health care they wish.
