As much as I love a good corrupt cop story, This one sounds like it was correctly handled. She wasn't drunk. She wasn't driving erratically the victim was walking in the middle of the street.

your body burns about a drink an hour. so waiting 2 hours can have a large impact on whether she was intoxicated or not.
so waiting 2 hours is approximately 2 drinks.
2 drinks for 100lb woman is approx .1bac

so yah, about that not being over the limit and not being legally drunk and not getting favored treatment cause she was family of a cop??

2) wait 20-40 mins while watching that they do not put anything into their mouth and retest.

Actually, because of the extremely clock-like way BAC can be measured now, it's theoretically possible to extrapolate backward from the time of the test to the time of the accident and estimate the person's BAC then. Given how low her BAC was at the time of the test, it's unlikely she was stumbling drunk only two hours earlier. A .057 BAC is way below legally drunk, so she probably was telling the truth about when she last drank. And we know she already admitted to drinking something as horrible as a wine cooler, so there's no reason to doubt her veracity.

Two hours would not, for instance, cause someone to test .057 if they had been at a .16 at the time of the accident. Certainly not a female, since we process alcohol more slowly than men.

Isn't it pretty much a mathematical fact that if you tested at .057 2 hours after the crash that you would have tested > .08 at the time of the crash?

She may or may not have been drunk. But if she tested at 0.057 two hours later she would likely have been above 0.08 at the time of the accident, which would get anyone not driving with a cop thrown in jail, even if it doesn't constitute any meaningful level of drunk.

Puking is your friend- just don't try to hyperventilate in the back of the cop car. Your lungs don't metabolise alcohol your liver does- it just comes out through the capillary beds on your lung surface. You are just stinking up the cop car- not dropping your BAC.

Dozens of sober drivers probably passed by the girl without hitting her. Do you think it's pure coincidence that the driver who hit the pedestrian likely had a BAC over the legal limit at the time of the crash?

If you are driving while legally intoxicated and hit and kill someone, you are solely at fault, as far as I am concerned.
