Good luck proving intent but given it's Texas I'm not surprised that law was passed and would be less surprised if a jury convicted someone with no evidence than a mere accusation.

In reality people take photographs that some consider pornographic but are at best bikini shots circa 1953.

The videotographer had the right but was being pervy in what he was shooting, the photograghers wanted privacy in a public area, and the white knight bike rider needed to mind his own business and his tough guy act made him look like a douche.


If anything I rooted against the bike guy who was "all in your shiat". If the video guy had punched him out that would have been the only good part of the video.


I want the right to be able to film in public but this type of video of someone getting cheap thrills hardly makes people sympathetic to your cause.

Few years back I bought a digi cam and while just taking random shots to get used to it I was surprised how some people were upset somebody was taking pictures in public places.

The picture that drew the scariest confrontation was one I took of a building. In his defense it was a bar and he probably thought I was some kind of investigator.

I must of really looked like a pervert back then or something. My favorite dirty look came from a group of fugly's. They were standing in front of a Picasso. The Picasso like eight stories high in Chicago's loop.

What were they doing there? Posing for pictures in front of a Picasso that's what they were doing.

If you decide to do ballet exercises in the middle of a NYC intersection, you have to accept the fact that more people than just your chosen video team are going to be filming you. The cameraman wasn't causing a disturbance, was staying out of everyone's way, and didn't say a word for nearly 3 minutes. He was minding his own business until the old bag started hassling him. Then the douche biker decided he wanted in on the action & only made things 3x worse.

If old hag & Mr. Soulpatch on wheels had minded THEIR own business, the crew could have finished their shoot and everyone would have gone about their day.

Actually, if you're in Times Square, you're probably not a New Yorker.

If the videographer wasn't Joey Boots (or whoever), then it was probably a tourist. Just like the biker. Just like the camera crew.

New Yorkers don't willingly go to Times Square unless they need to. It is literally infested with tourists.

Times Square is mostly for pedestrians. The roads are mostly blocked off except for a couple of lanes and cross-town streets here and there.

I would think it comes down to the question of consent. If the girl says to the guy "please don't film me" then the guy should respect that, despite his "right" to film whatever he wants, whenever he wants, wherever he wants. To me, at the point when someone asks you to stop taking their picture, they've clearly indidcated they do not grant consent, which trumps your right to take pictures in public. From then on, the argument that you don't need their consent and that whatever constitutional amendment covers public videography protects your right to infringe on other people's privacy is just douchebaggery.

That said, I agree with you that not a single person in this vidoe gets any sympathy from me. Not the ball-tickler sporting bike messenger, not the attention-whore teenage ballerina and her exploitative entourage, and certainly not Mr. Crotch-closeup video.

Thinking about it they probably would of been better off taking stills of just the street scene and photochopping her in later from studio shots.
