I didn't know you could do that and this lady completely missed the point.

I have left specific instructions for hot busty nurses of any color and how they can touch me. It's ok, I'll wait here.

Should've painted the ladies skin with iodine while she slept, then told her once she woke up that she'd been given the wrong color blood.

TFA: Elderly patients, who won more legal control over their quality of life in nursing homes, sometimes want to dictate the race of those who care for them. And some nursing homes enforce those preferences in their staff policies.

The law recognises skin colour?

The lady would have then gone on to become a deputy in a small town in Georgia.

This isn't going to improve care for elderly with dementia when the racial specification was made to avoid triggering psychotic episodes.

No where near as clear cut as it seems. Bad cases make bad law.

Heh. The Patients' right to chose the type of caregiver. Not really sure how I feel about this. On the one hand, you have racists idiots like this old lady.

On the other hand, do you want to a woman she has to see a male gynecologist? Do you want to tell a man he has to see a female urologist? If the point is patient care, shouldn't the patient be as comfortable as possible?

Assuming they're completely paying for it themselves, but if their using insurance, I sure wouldn't want my premiums paying for race or sex discrimination.

If your hypothetical female is in toxic shock, no I don't think the hospital is obliged to find a female gynecologist at a moments notice -- which is a closer analogy to the situation in question.

For regular care outside of emergency situations, people should pick their own doctor -- for whatever reason they seem to think is important. But I don't think the burden should be on anyone to accommodate it.

The article addresses this:

Courts have held that patients can refuse to be treated by a caregiver of the opposite sex, citing privacy issues. But the 7th U.S. Circuit Court of Appeals, ruling in Chaney's case last month, said applying that accommodation to race goes too far.

"The privacy interest that is offended when one undresses in front of a doctor or nurse of the opposite sex does not apply to race," the ruling said.

I don't know the particulars of what is required for a rape kit to be done -- but if it's time sensitive it behooves her to have it done immediately. But I think those can be administered by police or anyone qualified. But she's free to refuse.

Beaten within an inch of her life and hemorrhaging? Again, I don't think the hospital is charged with keeping preferred demographics on 24 hour call to save people's lives. She could still refuse I suppose.

Something less urgent, the lady has every right to refuse whatever treatment she wishes on any grounds. May not be all that wise however.

Well, who could NOT help her. Because she is legally prohibited from doing so.

Your little schtick there made it sound like you thought the nurse had a choice.

Also, I notice you failed to address my allegations -- some may call them scurrilous -- about your dance moves. I will take that as an admission.

At times I find myself wanting to tell Drew to have every Farker's age displayed in their profile. That way I can tell people who are culturally ignorant from those who are simply infants. A note about where they live might be good, too. I hate when I see an offhand snooty comment about "everyone knows THAT", and it turns out that the person in question is 15, or from Burkina Faso, and as such shouldn't have known.

That being said, if you're North American and older than about 25, and you have never seen Airplane? Sad.

But Chaney couldn't help the woman up. She had to search for a white aide because the woman had left instructions that she did not want any black caregivers.

I'm surprised she bothered looking for a white aide.
