Lost income? Makes sense.

Pain and suffering? F*ck you, pal. No way. You should consider yourself lucky that you're probably going to get a nice settlement anyway because Wienerschnitzel doesn't want to look crass, but you're f*cking blind. You can't blame people every time YOU run into shiat. Your cane didn't detect it? Probably because your cane reaches in front of your feet, not your face. Don't blame your inability to detect a tree on the fact that you didn't even try.

As for the tree, it does appear to be "encroaching" the sidewalk. At most, I would likely ask them to re-plant the tree facing a different direction rather than sue.

A defense usually available to the state, and the other half dozen people this fellow is suing, is that it's your own friggin' fault if you run into something that is 'open and obvious'. Traditionally, blind people are held to the same standard as sighted people when it comes to needing to be on the lookout for hazards. Me thinks his attorney is trying to extend the law in Utah. Either that, or the asshat is a publicity seeking media whore.

/I didn't always hate blind people.

Couple of things come to mind:
1. The tree was in the public way so the business is in the clear.
2. Dude is freakishly tall. The average person would be able to clear the tree, so it really isn't a hazzard. No one knows when a giant is going to come along most laws go for the average person not the abnormals.
3. Could the tree get a lawyer and countersue? It was just standing there when he assaulted it.
4. Why didn't his lawyer just leaf this case alone?

6'5" is not freakishly tall. 7'0" is freakish, 6'5" is just very tall.
