What about all the people you sent to those prisons, Mr. Kent? Should their sentences be vacated as well?

FTA: As a prisoner, former U.S. District Judge Samuel B. Kent has been shunted into solitary confinement, forced to hear the screams of another inmate being raped and ordered by a "cruel" sergeant in the Florida prison system to do calisthenics in the nude, according to allegations in a federal court memorandum filed Tuesday.

The people who shrug at epidemic of prison rape like it is no big deal, or should be expected as part of the "punishment" of prison, completely confound me. How exactly is an environment where you can be reasonably expected to be raped, or exposed to rape, not count as cruel and unusual?

Assuming he isn't just an asshole making this all up, which he very well may be.

The guy is absolutely, 100%, an asshole who is in prison for making stuff up. You can read up on his crimes. But he's not a violent offender; so even if his description of the conditions is overblown, I'm still not sure what could justify multiple transfers and solitary.

filth: I'm still not sure what could justify multiple transfers and solitary.

He is a judge that sent people to prison, which means he will not be in general population. That doesn't mean he will always be in solitary confinement, as they do have "special" housing units that could keep him in but the may have moved him to solitary for his protection.

The transfers are probably when someone drops the dime on him being a judge and they move him for his protection. The reason his location isn't listed on the inmate site is probably to protect his life. He is in a maximum security prison which means he is doing time with some very violent offenders that would love to put a judge on their rape card or shank card.

In the criminal prosecution and in congressional testimony, Kent was accused of repeatedly groping his former case manager both on and under her clothing and once attempting to force her to perform oral sex. He also was accused of forcing caresses on his secretary and of performing unwanted digital and oral sex on her.

He has the balls to say he's being mistreated? This dirtbag can rot right where he is.

Now, he doesn't want to suffer the same punishment for his crimes to which he's sentenced countless other people because he's "entitled".

The people that shrug at prison rape are also doing everything they can to live a life that keeps them out of prison. So when some guy sexually assaults his subordinates and then uses his position of power to protect himself we can either say "Damn, I wish I had that job" or "Ha-ha, now who's going to get digitally violated"?

It's a simple case of live by the sword, die by the cock.

The naked calisthenics thing sounds like something I've heard they do to new inmates as part of their strip search, it's probably kind of uncomfortable to touch your toes or do jumping jacks if you are trying to smuggle anything into prison hidden up your ass.

I'm also on the side of those who think the attitude of many here towards rape in prison is a little disgusting and constitutes cruel and unusual punishment, if you really think it's the right and proper punishment get it written into law and meted out impartially instead of allowing our prisons to function as little more than chaotic behavioral sinks, with as many nonviolent drug offenders in prison as there are do you really think that only the pedos and rapists and other pariahs get raped?

While this man is scum and deserves punishment for his actions, our system is broken and this report shows exactly how and why. His reactions to prison are likely the exact same as millions of others who went to prison for non-violent crimes and ended up getting violently raped, beaten, or humiliated.

awesomest judge ever before he went and got thrown in jail.

943 F. Supp. 782 KENT, District Judge.

"This is a breach of contract case based on an insurance contract entered into by Plaintiff and Defendant. Now before the Court is Defendant's October 11, 1996 Motion to Transfer Venue from the Galveston Division to the Houston Division of the United States District Court for the Southern District of Texas pursuant to 28 U.S.C. § 1404(a).

For the reasons set forth below, the Motion is DENIED. Defendant's request for a transfer of venue is centered around the fact that Galveston does not have a commercial airport into which Defendant's employees and corporate representatives may fly and out of which they may be expediently whisked to the federal courthouse in Galveston.

Rather, Defendant contends that it will be faced with the huge 'inconvenience' of flying into Houston and driving less than forty miles to the Galveston courthouse, an act that will 'encumber' it with 'unnecessary driving time and expenses.' The Court certainly does not wish to encumber any litigant with such an onerous burden. The Court, being somewhat familiar with the Northeast, notes that perceptions about travel are different in that part of the country than they are in Texas. A litigant in that part of the country could cross several states in a few hours and might be shocked at having to travel fifty miles to try a case, but in this vast state of Texas, such a travel distance would not be viewed with any surprise or consternation. Defendant should be assured that it is not embarking on a three-week-long trip via covered wagons when it travels to Galveston. Rather, Defendant will be pleased to discover that the highway is paved and lighted all the way to Galveston, and thanks to the efforts of this Court's predecessor, Judge Roy Bean, the trip should be free of rustlers, hooligans, or vicious varmints of unsavory kind. Moreover, the speed limit was recently increased to seventy miles per hour on most of the road leading to Galveston, so Defendant should be able to hurtle to justice at lightning speed.

To assuage Defendant's worries about the inconvenience of the drive, the Court notes that Houston's Hobby Airport is located about equal drive time from downtown Houston and the Galveston courthouse. Defendant will likely find it an easy, traffic-free ride to Galveston as compared to a congested, construction-riddled drive to downtown Houston. The Court notes that any inconvenience suffered in having to drive to Galveston may likely be offset by the peacefulness of the ride and the scenic beauty of the sunny isle: 'The sun is 'rize, the sun is set, and we is still in Texas yet!'

As to Defendant's argument that Houston might also be a more convenient forum for Plaintiff, the Court notes that Plaintiff picked Galveston as her forum of choice even though she resides in San Antonio. Defendant argues that flight travel is available between Houston and San Antonio but is not available between Galveston and San Antonio, again because of the absence of a commercial airport. Alas, this Court's kingdom for a commercial airport!

The Court is unpersuaded by this argument because it is not this Court's concern how Plaintiff gets here, whether it be by plane, train, automobile, horseback, foot, or on the back of a huge Texas jackrabbit, as long as Plaintiff is here at the proper date and time. Defendant will again be pleased to know that regular limousine service is available from Hobby Airport, even to the steps of this humble courthouse, which has got lights, indoor plummin', 'lectric doors, and all sorts of new stuff, almost like them big courthouses back East.

For the reasons stated above, Defendant's Motion to Transfer is hereby DENIED. The parties are ORDERED to bear their own taxable costs and expenses incurred herein to date. The parties are also ORDERED to file nothing further on this issue in this Court, including motions to reconsider and the like. Instead, the parties are instructed to seek any further relief to which they feel themselves entitled in the United States Court of Appeals for the Fifth Circuit, as may be appropriate in due course. IT IS SO ORDERED."

No. Prison is not supposed to be inhumane torture. Prison is not supposed to include rape, beatings, humiliation, and pain. You have to be one sick, rationalizing, mentally lazy SOB to think that someone deserves to be shackled inside a stone wall, raped nightly, and have basic life necessities ignored by your guards for YEARS at a time because they stole a TV.

Regardless of how you feel about this scumbag judge, the fact that we allow this type of torture in the United States is unforgivable (assuming its true).

Keep in mind that nearly 1 in 15 of us will spend time in prison.. that's a rate about 10 times higher than the rest of the world on average.

We have 25% of the entire worlds prison population and only 5% of its TOTAL population.

Less than half of all prisoners are there for violent crimes.

Stories of prison abuse and torture are routine and after convicts get out, they are basically subject to a blacklist in the rest of their life, almost guaranteeing they will go back at some point.

Remember, of all the people we are sending to a cage to be abused and possibly raped, less than half of them are there for actually hurting anybody.

I don't think anyone's shrugging their hands at the prison rape and suggesting that it isn't a problem. However, I'm upset that someone who has sent other people to the same federal prisons that he is now incarcerated in is trying to have his sentence commuted because of bad conditions. If the conditions are that bad (and they are, from the sound of it, very bad indeed and desperately need to be improved) then Mr. Kent shouldn't have been sending other people there.

In fact, as a federal judge, Mr. Kent may have had some ability to exercise oversight of this facility, and perhaps should have been more concerned about inhumane conditions before he was sentenced there.
