They could have busted him for public intoxication alone. In other words, drinking is legal but only if it's in your house, in the closet, with all the lights turned off.

He says "I'm not a negligent father you know and I love my kids, I never put them in jeopardy and maybe that day I made a stupid decision but you know everybody makes a bad decision, I mean no one wants to hurt anybody, especially not their own kids."

I read the headline with slight outrage towards whoever arrested him, thinking that maybe he was just slightly buzzed at a fair or something that isn't a big deal. But the part where he passed out and needed to be hospitalized because he over=drank kind of made me feel like he deserved it.

I see nothing asinine about him being charged for this (assuming that was subby's message). While pushing children in a stroller you are solely responsible for their safety and well being--especially if you're near any traffic. The man even admitted it was a stupid thing to do.

. . . if he were charged with DUI/DWI, then it would be asinine.

I'm picturing one of those "dad was drunk so the 10-year-old drove home" stories, except in this case the dad was drunk so the toddler stuck him in the stroller and pushed him home. It's a funny visual.

Or maybe it isn't. I don't know. I'm not you.

Police say he passed out when they took him to the Richland County Jail to be booked, and he had to be taken to a nearby hospital for treatment.


I gots kidz. 1 and 2 y.o.. I have a couple beers and take 'em to the park. Sometimes I take a bigass travel mug full of beer with me. We have a blast. But I'm talkin' 3, 4 light beers here. This guy was friggin' wrecked. You...you can't do that.

It sounds like he was completely sloshed, so I don't see what's all that asinine about this. The child endangerment stuff might be a bit much considering the likely consequences, but it's probably not that much of a stretch if he was so drunk he passed out during booking.

Melendez says "point blank I was wrong, I shouldn't have went out and had anything to drink, I mean I wasn't stumbling stupid drunk or nothing but you know it happened, it's over. I've just got to go and do what I have to do to deal with it."

Melendez says he is now taking steps to treat his drinking problem.

Melendez is now hoping to convince the judge hearing his case that he is a changed man and that he belongs in treatment as opposed to jail.


Oh look, he is already practicing his speech for the Judge. I'll give him an 8/10, he needs to practice and fine tune the speech a little more in preparation for the actual judge.

I still think this was a bit stupid - but I am not quite sure how drunk he really was and really don't want to form an opinion. I have been know to wander away from the safety of my castle's boundary while a tad bit tipsy as well.

Also, TFA says he was so plastered that neighbors called 911 when they saw him. He says he wasn't "stumbling stupid drunk", somehow I don't believe him.

Having a few drinks isn't intoxication. If you plan to get so badly drunk that you end up in the hospital, then yeah, do that shiat at home, nobody else wants to be around you.

both of which will get your kids yanked at least temporarily.

i left out part of my thought. I was trying to say that if he was taking the kids with him because he couldn't leave them alone, then he would have been severely drunk and alone with the kids, then bla bla bal rest of my post.
