I was at the Centennial (CO) Benchwarmers on Wednesday for happy hour. I walked in and wires sticking out of the wall as earlier that day all of their HDTVs were repo'd. The busty waitress, who I was later told had a face, said they just ripped them from the walls in front of customers during the lunch rush.

A little while later the manager came to our table to chat it up and talked about all the cool things he's planning on doing, such as sportstalk radio remotes at their place. In retrospect I think he was trying to map out in his head how he could grab all the cash in the office safe and make a run for it, but considering how cash-poor this franchise obviously was I figured the office safe only had 36 bucks and a dog-eared copy of Hustler. Sad, really.

The first time a paycheck bounces, go after them hard and fast while looking for another job. They are in breech of contract.

In TFA, they said they had been authorized by management. Would they then be doing something illegal? I honestly don't know...

The article doesn't say there is any bankruptcy filing so how would it be theft?

It's not that insane. Of course when the first paycheck has trouble you start looking for a new job but one bounced check doesn't mean you won't get any more money out of them. Thus it makes sense to keep on working while you're hunting even if there are paycheck problems. Of course, if you find something you start immediately.

The UCC frowns on these shennanigans.

I think that was in the Boston area. Corporate called the bar and said 'shut down everything' servers/chefs/bartenders kept serving and accepting cash until everything ran out.

My former roommate worked at a restaurant that bounced the staff's paychecks a couple of times.

The first time, she lived on her tips.
The second time she had another employee cash the cheque out of the till. And then she returned the favour for the other employee.

The boss was screaming mad, but they didn't care.
What was he going to do? Call the cops? Stop paying them?

I have worked at a few restaurants that have bounced checks. Usually it is just an accounting error of not moving money to the payroll account in time. It was rarely a big deal, if you were a server or bartender. I always forgot about paydays since the checks were usually only for $20 or so, sometimes you received the check that said "this is not a check" because you didn't make anything. Servers hourly wages usually only cover the federal and state taxes and most of the income is from tips.

Worked for a union HVAC company where the owner's sister kept hitting the till. You would get paid at noon and race to the bank - or the checks bounced. Was shame as he and his foremen were a good bunch to work for - christmas party was at a bar - order/drink whatever you and your spouse wanted. Some guys got really ****ed up those days...

It said it was authorized by the local manager. That's not management of the business, but the local pigfarker. Since, the chain seems to be circling the toilet, then presumably they will go bankrupt. And then creditors will pick the carcass clean. And since banks and other businesses are considered more human than workers, they would get first rights to the still warm corpse. That mere peons were not properly shiat upon will be considered poor form, and said slaves will have to suffer. I didn't say it was right, just that the idea of some normal person gaining some minute benefit is not how American law works and said serfs will feel the pain of the lash from their "betters".

I work for a large national retailer and one week our payroll checks got stuck in a snow storm and couldn't be delivered on payday. For all the people who still get paper checks we gave them cash. It was on Christmas Eve. So you have dozens of people with cash in hand on Christmas Eve; I bet more than half was spent before heading home that day.

Always cash your paycheck at THEIR bank, not yours, if it does bounce, you already have the cash.

Had a family member who produced an awards show who got stiffed by the organizers. Paid all of the freelance workers out of his own pocket. He never got paid...

Sadly, this is why so many restaurants when they are going to shut down shut down with absolutely no notice. It's not that they're just so out of touch with workers living paycheck that they don't care about what's going to happen when workers come in for their shift to a note on the locked door. It's to prevent them stripping the place.
