New charges can be brought if evidence supports it. Even if convicted of new charges, a death penalty would likely not be pursued as with the last conviction, the fact that this a$$wipe was a juvenile would probably weigh in.

Indeed the Supreme Court ruled definitively that capital punishment for juvenile crimes violates the Eighth Amendment.

I would bet that capital punishment will be banned entirely in my lifetime. All trends are against it.
