I read that they do virginity tests on boys in South Africa. Boys and girls both, but it was the part about boys that caught my attention. In Africa they look at the penis to check for virginity, not the ear as in Vietnam.

Look at it this way: if Vietnam's judicial system uses an "ear spot virginity test" to set convicted rapists free, there's a good chance they were wrongly convicted anyway.

I pointed out that the word of the healer may have been enough to force investigators to reopen the case, but not to prompt the investigators to find (according to TFA) numerous errors in the original investigation.

The fact that the original case was F'ed in the A does not suddenly make magical superstition like the ear-spot technique of virginity confirmation any less stupid and dangerous to an objective pursuit of justice. It's great if they have discovered an unjust conviction but that was a happy accident, and we should not suddenly grant credence to someone's silly superstitious pretensions because of this happy accident. Not to mention the fact that sloppy prosecution and the actual guilt of the convict are not mutually exclusive propositions.

True; but if I were the convict in this case, I wouldn't care.

We need more people protesting convictions (and I'm with you that those grounds should be as scientific as possible), and if the courts decide to look into them, I bet a significant number could be reviewed/reversed. I do not believe that prosecutors (even in countries where trials aren't adversarial) are infallible, and I suspect that the same deference is paid to law enforcement in other countries as the US.

What if you were the victim and, though the courts didn't adequately prove their case, the convict did in fact still do it? Would you care then that some witch in heat for your rapist got him off with maddeningly absurd bullshiat about virginity and a dot on his ear?

Ok, protest convictions, but this case shouldn't be held up as an argument for that.
