He apologized to BP.

Then he went on about how BP was at fault.

Basically, I think he thinks that BP shouldn't pay a dime until they get sued and it goes through a court, and how they forked over $20billion wasn't necessarily right because there was no "due process". Which is kind of a lame technicality, considering everyone is saying BP is at fault, even BP, and they could have gave Obama the middle finger and taken their court option.

And he was right, Obama is not a court of law. Saying you think he was a really great judge doesn't mean he has the right to conduct a shakedown. They are already talking about using this $20 billion for health care. It's not going to go to the people who need it, and it's not coming after an open court process.

There have been tremendous mistakes my Obama that are the reason this oil has caused so much damage. Our president's little fiat, that they would have to take this deal, is avoiding the open court process that could establish liability.

Barton's an ass because everyone knows BP did something terrible and really terrible bad guys don't deserve a trial. Only Barton thinks we're a nation of laws and even the bad guys deserve a trial.

Barton should have been smarter about how he made this comment, and should have asked questions about this process instead of made a sympathetic comment to hardcore democrat operation: BP. So he was a bit of a bonehead.

But he was right. It is shameful and all right thinking people are sorry Obama broke his oath, quite obviously, in demanding a penalty instead of permitting the legal process to occur.

You can say BP freely agreed, but you're a liar to do so.

I think you're pretty much correct. However, I don't think anyone should be apologizing to these guys about anything right now. Maybe if you tripped and accidentally raped their mother, but nothing else.

Due process is not required. If the government ordered them to pay $20b without their agreement or consent, that would be a violation of due process.

On the other hand, if you grudgingly agree to pay for a shelf full of china you just broke, nobody is violating your right to due process.

It's not lame at all. Even the Nazis got a trial, and BP could owe far more than this.

and who do they owe this money to? They don't owe it to Obama's pet projects. This money is already being discussed as going to healthcare funding. Who knows who will get it.

This isn't the way our laws are set up to handle legal disputes. Simple as that, Obama broke his oath, and he needs to be condemned for it. This is creepy.

It's not lame because BP is deeply unpopular and obviously in some kind of huge fault to others. This kind of deal only is done to the unpopular or the totally screwed. Obama is taking advantage of this opportunity crisis.

He swore to uphold the constitution. He does not have this power to force settlements with himself for you or me.

I don't think this is a penalty separate from the legal process. I think it is BP making a downpayment on the ultimate legal fees. Basically, all this does is cover compensatory damages for all the people out of work. If the ultimate compensatory damages are greater than $20B, BP will pay more, but if they are less, BP will get whats left over. Punitive damages will be covered in court for years to come.

I like when he said that pre-court settlements are unprecedented, and implied that if nobody sues you but you agree to settle voluntarily the person who negotiated the settlement should go to jail.

What a failure of an understanding of what due process is and how it works and the court system and how people can settle disputes outside the court system.
