Well, in some states the breathalizer isn't the end all in a case of this nature. It can be thrown out in court seeing how the field breathalizers are highely inaccurate.

But...why not prosecute a celebrity to the fullest extent of the law?

Video tape helps a lot. Hard to argue the fact that you were sober enough to drive if the jury sees a video of you staggering around and slurring your words.

notice the atttorney DID NOT say the results are wrong just that they may have been obtianed wrong. screw her and all drunk drivers.

FWIW yes i have but i grew out of it. as the home owner told me later: "the kids didn't use that swing set anymore".

1. A blood alcohol test is not necessary to convict someone of DUI. The videotape of her behavior and the field sobriety tests should be rather telling if she was a .20.

2. A field breathalizer is highly innacurate and is generally not admissable in court. However, the Intoxilizer 5000 (standard police station model) or a hospital blood test are accurate to within .001, and are generally indisputable.

3. Most states have something called "implied constent," meaning that when you get your driver's license, you automatically consent to any blood, breath, or urine tests when you are pulled over, and if you refuse those test upon the officers request, your license is IMMEDIATELY revoked for a period of at least 6 months, sometimes longer.

Typical defense attorney tactic......attack the reliability of the BAC gathering equipment or/and attack the collection procedure by the officer. The officer that administered the FST's and the blowmachine has 16 years experience and is assigned to the Tucson DUI task force. Mistakes possible? Sure....but unlikely. Also not mentioned in the press is the fact that Miss Drunk Supreme was provided with a sample of her breath test so that she could have it independently tested at the facility of her choice. Betcha the results get buried. She was drunk.........and as usual, unwilling to take responsibility for her actions. Typical hollywood asshat.

CommanderApaul - the Intox 5000 has a built in error range of .02.

That means if you blow a .08 and a .06, the machine will automatically ask for a 3rd reading 'cause you hit the range.

That happens pretty often, I've had DUI trials where the machine took about 5 readings which were all over the place.

I also practice in a jurisdiction where the local intoxilzyer took a LIGHTNING STRIKE and FRIED because it lacked a surge protector. Instead of buying a new one, they replaced 25% of it.

I tell every DUI client that comes in "you know you could have refused to do the 'voluntary' field sobriety exercises?"

99% have no idea. (Yes, your license will be suspended for 12 months. If you get convicted of DUI you lose your license anyway).

The real downer is Florida has this ridiculous law where the 2nd time you refuse to blow is a misdemeanor.

Name another crime where it's only a crime the SECOND time you do it.

Correction from above in FL:

If you refuse Field Sobriety Exercises, they have do decide whether to arrest or not based on what they have. Smell of liquor isn't enough. No automatic suspension.

If you refuse to blow, they will suspend your license for 12 months.

If you are convicted of DUI, you get a bunch of stuff including a 6 month DL suspension.

Without the blow, might be worth going to trial over... with the blow it's a slam dunk for the state.
