When the clerk tried to pull it back down, surveillance video shows Frederick going after him. That is when the off-duty officer allegedly punched him in the face...

"It gives law enforcement in general... a black eye..."

Clerk: "Oooooookayyyyy."

We tried to speak to the couple, who share a home in Romulus. Their Ford Explorer with the bent license plate was there, but no one came to the door to ream us.

Fixed.

she didn't 'come back in to buy liquor', the liquor was already purchased before she stole some pizza slices

We are told Frederick is facing a misdemeanor assault and battery charge.

Misdemeanor A&B? They stole and used violence in perpetrating the crime. Sounds like a felonious strong-arm robbery to me.

He hit the clerk after the "robbery." Robbery requires force or fear to effect the taking of property, which was not the case here. If that sounds like splitting hairs, it is, but the battery charge will likely stick, where the robbery charge would not.

Wouldn't the robbery charge result from the woman flashing her badge and telling the clerk to fark off, with "flashing the badge" and what it implies constituting the "fear"?

They officially enforce laws. You could say that makes them law enforcement officers, which are commonly referred to as police officers.

This new style of reporters waving their hands and doing all kinds of body gestures bothers me. Is it a Fox news thing? When I worked for TV news the producers would have laughed at me and refused to show the clip until it was changed.

I don't watch enough tv news to know if this is the new fad or not.

If you encounter a TSA employee acting up outside of an airport, treat them with as much respect as they do to you inside the airport. So strip 'em naked, rifle through their stuff and ruff 'em up a bit.

This. I'm no fan of the police, but let's at least not give the cops any extra bad press. Law enforcement probably stopped this from being a drunken thieve beat down. The two thieves were wanna be authority figures, not Police. Bad reporter [hits reporter with rolled up newspaper].

Charges against cops are added up using reverse police mathematics.

I don't understand why an off-duty cop stopped at the scene, but the couple still left before other officers arrived. If the couple weren't officers themselves do you think he would have held them at gunpoint?

gregormendel: TSA workers are NOT law enforcement officers.

Meter maids have less power, but they're still "law enforcement officers".

They've got badges and uniforms. They have the power to legally detain you, strip search you, etc. Their scope of authority may be limited but they are unquestionably part of the "law enforcement community" (or cogs in the police state apparatus, if you prefer to phrase it that way).

He was just pulling up to get gas and had no idea what was going on. He just intervened to stop the situation from escalating and had no reason to stop the couple from leaving.

But you would be tragically, horribly wrong. TSAs are not LEOs. The week or so of training they get in how to feel up grannies and tell the difference between a 3-oz and 4-oz bottle of shampoo isn't anything like what real LEOs go through. TSA folks are basically glorified mall security guards.

He probably wasn't carrying his gun, since he was off duty. Not all cops do. Also, at that point he didn't know they were cops. He jumped out of his truck and was trying to break up a fight.

Also the story said he was with the Sheriff's department. In my experience deputies are a lot more laid back. They mostly just handle things like serving warrants and transporting prisoners.

2010-05-02 06:06:54 PM
The difference between the TSA and mall cops is that a mall cop would probably be fired for harassing customers without provocation, strip searching old women/children, and detaining people for hours without cause. The TSA agents, on the other hand, get paid suspension and a half hour "retraining" course.

2010-05-02 06:13:15 PM
Prank Call of Cthulhu: TSA folks are basically glorified mall security guards.

Private security guards have no power or authority over and above what any other ordinary private citizen has. Actually, they have less -- many private security companies forbid their guards to effect a citizen's arrest, even when it would be legitimate for them to do so, out of fear of being sued.

TSA drones DO have powers above and beyond what is permitted to us lowly civilians. That power is limited in scope compared to that of a fully-sworn police officer, but it still exists. No mall security guard has the legal power to strip-search you, or to forcibly detain you if you don't consent to a magnetometer sweep -- the most a private guard can do is tell you to leave private property, or call a real cop.

(Of course if the rent-a-cop is ALSO an off-duty real cop, that's a different story)

Depends on the location. Some places, there are separate Sheriff's offices and Police Departments. Other places, County Sheriff is the only agency with jurisdiction. But, even in the former case, Sheriff's Deputies are still sworn police officers with full police powers.

The oath we took, and the fact that she used her farking badge to try to get something. That is, to the best of my understanding, an automatic termination.

I have a friend who's a deputy, we actually just discussed this last night. He thinks the reason city cops rank so much higher on the dickhead meter than sheriffs is because they usually have backup less than a couple minutes away, allowing them to run their mouths and be abusive to people. Deputies, on the other hand, need to know how to disarm a situation verbally, since there may only be 5 of them on the clock for an entire county at any given time.

No, if you don't pass, you don't qualify and, if I recall correctly, you have to wait quite a while before you're allowed to take the test again.
