And? The death penalty for murder doesn't provide an incentive for people not to murder. Most people don't think about the likelihood of being caught and punished until afterwards. Same for rapists and molesters. It's only afterwards that they say, "oh, shiat, I might go to jail for this." Except under your proposal, it's "oh, shiat, I might get executed for this... might as well kill this witness, since they can't give me the chair twice."

Absolutely. Bear in mind that this all occurs after commission of the crime. This is why the death penalty is not a good deterrent in general. Before the crime, you aren't thinking. After the crime, you are. And if, after the crime, you see a way to reduce the likelihood of being caught - say, by killing the witness - with absolutely no possible harm to yourself, since it's death penalty either way, then you'll take it.

What other theory are you going on? That child molesters and rapists are insane morons who never, ever act logically? 'Cause it seems a lot more likely, in light of the fact that many of them fit perfectly well into society such that we never know until it's too late, that they can act quite logically and rationally and are just sick.

That argument has been used for decades, based on haphazzard research that suggested, essentially, that "murder rates in a jurisdiction that implemented the death penalty didn't change significantly after instating the death penalty in comparison to when the maximum sentence was 'only' a life sentence with no chance of parole."

It's never been empirically tested to determine if giving more public access to executions (via television, or perhaps public hangings, as an example) might indeed have a deterrent effect on serious crime, like murder.

Bottom line is...it sure as HELL provides an incentive for that specific criminal not to murder again, doesn't it?
