I think that her Dad should be allowed to throw a freebie into her. From what it sounds like, it probably won't mess her up that much more.

Where's all the feminists decrying that prosecuting her for false reports will stop other females from reporting rapes? After all, 17% women are raped. Bad decisions to females = rape these days. If both are drunk, only the men are raping.

If I was on a jury, I would never convict based on nothing more than he said/she said. An allegation is not evidence enough that a crime has been committed.

Sort of. That has to first be arbitrated by a Rape Panel.

From the comments on the article:

Well, if guys can call any girl "slut", "hoe", etc because she had "consensual" sex with them and damage her social life, It's only fair that girls call any guy who sleeps with them "rapist" and do the same damage!

You know, it's not too hard to figure out what's wrong with people.

Some say that 0% of rape allegations are false.

Some say that 100% of rape allegations are false.

I don't know about either of those, but one thing I do know is that this means 50% of rape allegations are false. This is an outrage.

What's frighten is the fact she was never raped, therefor no physical evidence, so basically the father was sent to jail on just the daughters word alone.

What the hell was the trial like:

Prosecutor: Did your father rape you
Daughter: Yes
Defense: No he didn't
Judge: Case close, 5 years in PMITA prison.

Depends on how much she had to act. Think Beck level acting, tears and all. Oh and at least one recess in court due to victim "breaking down" to get hearts to bleed.

FTA: "The conviction was overturned by the court of appeals at the request of the prosecutor."

Would never happen in America.

2010-03-22 09:44:00 AM
In the US this would never work. Rape victim privacy laws forbid rape accusations from being used in court, regardless of outcome. That makes it very hard to charge someone with making a false statement to police... when the statement itself can't be used in court.

This happens all the time. It's a loophole that really should be closed, but likely will take 200 years of bitter fighting.

Considering there's reasonable doubt in every he said, she said, that should be everyone's policy.

It is WAY too easy to make this accusation and the accusation alone can be enough to ruin someone's life and reputation. Then you have bleating idiots like Gloria Alred going on TV and talking about how "brave" women are to come forward. Well, half the time they aren't "coming forward" at all because both the authorities and media agree to withhold their identities. The identity of the accused guy, though, is splashed everywhere. That isn't brave.

I have the misfortune of knowing a woman who, in her past, made a false claim of rape. She STILL doesn't feel bad about it because she justifies as "well, I'm sure he WOULD have."

MyRandomName: Where's all the feminists

decrying that prosecuting her for false reports will stop other females from reporting rapes?

Depends on how you define "false reports". If you can prove beyond reasonable doubt that an accusation was false, then by all means, convict.
The problem is that too many MRAs place the "false report" bar much lower... as in failure to convict the accused = proof of a false report. That prevents other victims from reporting rape. Consider if you were mugged, press charges, and the jury decides to acquit for any one of a number of possible reasons, from reasonable doubt to legal technicalities... and then all of a sudden you're up on criminal charges.

The answer isn't to bring criminal charges against every victim, the answer is to have a gag order until the sentencing phase of trial. The accused, though innocent until proven guilty, is nonetheless convicted by the media. That's the problem, and that's where you should look to the solution.
