They're not stupid. The kid commandeered Wal-Mart property to commit an act of mass racial harassment and intimidation. He deserves to be punished, and his punishment should be (relatively) severe.

He's not going to go to jail over it. But he will end up with a juvenile record, a bunch of legal fees, and probably community service doing some kind of menial work in black neighborhoods.

Except the problem is that the so-called "charges" that he was arrested for are borderline at best. Harassment and intimidation? Really?
And as far as "enforcing the law" goes, do you see a cop pulling over everyone that's doing 5 over the limit? No, you don't.
The better cops in this world know how to make good judgments on when someone should be punished and when they should be let go. The bad cops are the ones that go "enforcing the law" blindly.

Not exactly. The cops' job is to bust the object of a complaint or disturbance, and then find a charge to stick him with afterwards. So they'll charge him with a laundry list of vaguely relevant charges; loose pants becomes indecent exposure, talking becomes terrorizing, etc. The district attorney's job is to find the one charge that might actually stick, and discard the rest.

When I worked in a substance abuse place we often had incidents that involved racial slurs. Two black guys fighting, dropping the N word back and forth. Who always got upset? Our white bread social worker. Once time she left CRYING because they kept saying the N word. If she happened to be in this walmart she'd be suing right now.

In Weaver's defense, that sounds like a "we were just following orders" argument. I think it's not so much cop hate, so much as cop indifference. If the police don't care about the populace so far as only enforcing the law, then they shouldn't expect anything other than that same business-only like attitude from people.

1. First Amendment protects this kid REGARDLESS of the bullshiat "bias" and "harassment" claims the cops are tossing around. Notice they had to wait several hours from arrest to announcement because they had to scour the law books to find what law the kid broke... which in actuality was "none".

2. If the ACLU actually had balls, they'd already be on this kid's side, fighting for his right to said 1st Amendment.

3. The kid is a bigoted idiot... that's not illegal in this country... thanks to, oh you guessed it, the 1st Amendment. If being a bigoted idiot was illegal, the Klan would be arrested every time they showed up. As a matter of fact, the Klan holding up signs denigrating blacks, hispanics, catholics, etc. could also be construed as "bias" crimes... yet they have never been prosecuted for it because of... oh, you better believe it, the 1st Amendment.

4. This is not akin to yelling "fire" in a crowded theatre, which inevitably some asshat is going to compare this to. It didn't induce panic, it was immediately addressed by a real employee, and quite frankly, nobody left the store.

Finally, 5. The punishment this kid should receive is not a year in Juvy... the authorities should print up a t-shirt that says: "I made the racist announcement at Wal-Mart", printed on the front and back... then drop him off in Camden, NJ with no money for bus fare.
