Racial harassment is a whole lot different than just being picked on, submitter.

I was picked on constantly when I was in high school, but I wasn't called racist names or nor was I the target of racially motivated threats. The school knew what was happening to this young man and did virtually nothing.

If schools want to claim that they are "in loco parentis" in order to justify unreasonable searches of students and drug tests without probable cause, then they sure as f*ck had better satisfy the parental responsibility of keeping their kids safe.

2010-03-13 08:46:40 AM
kronicfeld: "in loco parentis"

I thought "loco" meant "crazy," so schools are just required to act "like crazy parents."

Which they do quite well, mind you.

Um....Buck up. Realize that your school years arent the only thing you have to look foward to. Once you get to college, yeah there are the same kinda asshats, but you'll be able to find your own niche too. Be more mature, stick your nose in the air and live your life.

Asinine? The article stated that the school did not properly address his complaints, that they basically did nothing. It would be nice to see, in addition to the award, someone being fired for their role in bullshiat like this. Hopefully the kid went to college and is having a better experience there.

I don't see how it's different, and I went through years of a "living hell" too. Kids will harass anyone for being different or whatever reason they can come up with. Height, weight, intelligence, clothing, skin condition, etc.

And in every instance, they can be as cruel as someone who is harassing someone for their skin color.

Big farking deal. My father is a Colombian Jew and my mother is a white methodist. I look like a midget dark skinned Jug eared nosferatu. I got called all manner of racial slurs in high school.

But I blew it off, because I realized it was just farking high school.

I do not want to hear that the school should be out there protecting the snowflakes. Because pussy parents of pussy kids will sue if you even give the kids a harsh look.

High is a Darwinic rite of of life passage. You take the good with the bad, and you move on.

I would love a big pile of cash, maybe I should sue because i got a wedgies in 1982.

Thank goodness it was the full $1.25 million. Doubtless the reason the school was so indifferent was because they were distracted by having to count all those $100 bills every day.

2010-03-13 09:40:22 AM
The real problem is that due to "zero tolerance" policies the school would NOT have turned a blind eye to the black kid laying an ass whupping down on the kids that were making him miserable.

/had to put up with the same shiat in HS
//not the racial shiat but the BS
///once got suspended for being randomly sucker punched by another guy
////not that my HS was anywhere near as bad as it sounds like a lot of them are today

I don't wanna feed what could possibly be a troll, but, I did read the article. I also took my experince as being the ONLY latina in school through my jr. high years, and learned to think on my toes. If you don't react it becomes less fun, also if you happen to be kinda funny and are cute in an imp-ish sorta way helps. But in his case the school's job is to provide you w/ a basic education. It doesn't promise you a bed of roses.

All through grade school I was chased and beaten on by thugs that had to repeat the 5th and 6th grade.

In Thailand they do it without all of the screening or head shrinking process that is recquired in the states. Hell, you can get it done here in Colombia.

School has an obligation to have everyone get a long, hold hands and sing kumbaya? Didn't know that. The school is there to keep you alive during those hours teach you how to pass a test and get you outta there.

I am not missing the point, but being PC has turned into a double edge sword.

If the school would of reprimanded the students who called him a beaner, wetback, spic, or whatever the slur might have been, then the accused parents would have lawyered up as well.

Ashtrey: No i havent' read the article or the thread, why do you ask?

No need to ask. I just assumed you didn't read that this was a decision made by a jury and you didn't read the statement from one of the lawyers, "If they're deliberately indifferent to the harassment, then they're liable," he said.

The school's inaction is what exposed them to liability.

Unless the whole case is linked to or posted online we won't know the whole circumstances surrounding it. So as much as I'd like to agree with you, none of us know what was really going on. I'm glad you made it through your situation but you can't speak for this kid.

Besides a jury just decided the school farked up. So you have a problem with the jury's decision?

Tell us what other torment at that school was going on, and how that school system responded, or didn't.

Some people can take that shiat, and some can't. It's not like the adults at the school didn't know something was going on--I work in the schools, and those kids are watched like a hawk. Because they're all insane now, and if you aren't watching them constantly, even the "good" kids will do something like take a shiat in the hallway or steal everything that isn't nailed down. But I digress.....

Being bullied in school is abuse, and it leaves its mark just like any other abuse. Maybe it won't affect you for years after leaving school....but maybe it will. If the jury heard the whole story and decided that this kid's story was worth a million dollars, then maybe it was.

My high school years were a living hell too. I didn't sue, I changed the aspects about me that made me a victim. I'm a totally different person than I was in high school, for the better. I guess I over compensated for those feelings of being inadequate and have really excelled in life after high school. Even dating the chick I had a crush on in high school but was too scared to talk to; and she is still hot (good genes).

Too bad this guy can't change his race; that's an aspect of high school bullying I never faced. I never went for help either like him. Would have sucked to have my request for help ignored. Maybe now the school will pay more attention to these things.

They are obligated to provide a safe environment. The chose not to do that. Time to break out the checkbook.

theflatline: I am not missing the point, but being PC has turned into a double edge sword.

The judge and jury would say that you are missing the point. It has nothing to do with "being PC". The school failed at an obligation. I imagine in the future they'll meet that obligation.

By high school, I came to a combination of learning how to dress and groom, and embracing my quirky personality and choosing my friends wisely.

As for the torture in Junior High, I'd like to exact revenge, and $1.25M would be satisfactory.

Now, how can I get a million busk from my parents for dressing me in polyester and horn-rim glasses in junior high?

I decided before my kids were born that they wouldn't be yoked with looking like a dweeb.

Good for this kid but I want my bully funds too. I used to wake up every morning thinking "It's torture time, it's torture time."

I would like to sue my most significant bullies and their families rather than school districts ... that'd learn 'em. Kimmy et al, you owe me 1 mil each.

bmr68: Btw subby Pine Plains SD is up in the Woodstock, N.Y. area.

Pine Plains and Woodstock are about as different as Hank Williams and the Grateful Dead. One's a farm town with a few second homes sprinkled around, the other's a place where rich yuppies go to align their chakras and pretend it's still 1969.

The plaintiffs' lawyer may have seen himself an easy mark in a country-bumpkin school district that didn't have their shiat together when it came to complying with the whim of every dictate out of Albany.

And now a big can of worms gets opened. Wait until the first Chinatown kid sues the NYC public school system because the thugs pick on him.

It sounds like he was being threatened with violence over his race, and the school knew and did nothing to stop it. This was hardly being "picked on." Asinine tag is for submitter; I think this poor kid deserves that money, because clearly his school failed to protect him from fellow students.

Yeah. The school is being punished for not making a reasonable effort to solve the problem. I'm afraid such verdicts are necessary to get schools to act. I was badly bullied in grade school, the school knew what was up, the cops knew what was up, nothing was done. That sort of thing needs to stop.

I agree that the fact that it was race doesn't matter. The school sitting on it's ass about it matters whatever the motivation.

It depends on what form the harassment takes. For me it was a matter of constantly trying to avoid being beaten up. (And don't say fight back. That made things worse.)

I know, I just don't get it. If somebody is threatening a kid with racist violence, do you REALLY want to tell him to just suck it up and deal with it? Hell no. What happens when get gets attacked and killed? Nobody should ever have to deal with that kind of harrassment, and it's not ok because some idiots see it as some kind of "rite of passage." It's a school, they can and should have standards of behavior and consequences for those who break those standards. It sounds like they did nothing to protect this kid (like, say, enforcing suspension or such for those who bothered him) and basically didn't care. Not ok.
