In New York "criminal possession of a weapon" is nearly always a joke charge. It's something police tack onto other offenses -- in this case, assault -- to make the case fluffier.

you sir are the only rational person here apparantly. Each story is extremely different from the other. Clearly one side is lying in a big way, but I see no reason to believe one over the other. Unfortunately, things like this will often ben judged by characterizing the people in question. The culprits have priors, which does not bode well. I wonder what this cops record is in the past. Frankly, i would not be shocked if the supposed culprits were in the wrong and were harassing some guy. Was the guy right to pull his gun? Well what should he have done? Reasoned with them. This will not have a good ending. To many questions and no concrete answers.

absolutely not. Honestly, the first thing i said when i saw it was, these kids got a good lawyer and hes playing up the media. So far hes doing a good job of it, given the article. But they do not look super innocent to me.

I am inclined to believe the cop on this one. They thought it would be funny to throw snowballs at him and he reacted accordingly. It is a bad idea to throw anything at the police. But I could be wrong as I was not there.

If the cop's story is correct then I'd side with him. If the guys were being dicks and harassing him for giggles then it's still battery, right? Plus, have you ever been hit with a hard packed snow/ice ball? That shiat hurts.

On the other hand, I could see some scuz-bucket variety cop making up the story to justify pulling his piece on them because he was pissed off about something else.

/hopes there was a security camera somewhere nearby that caught the action.

I'm inclined to believe them. He was off duty, out of uniform. If a stray one hit him, I could see him throwing an ego trip and demanding their arrest. the blue line would back him up no matter who was at fault.

thank the lord you do not work in the court system. First of all, who knows how much Spanish each of them knows. Secondly, if you live in new york, people use lots of spanish slang in common usage and dont necessarilly speak spanish. So who knows what they said if they said anything. Like I said. This is all he said she said. And if the kids have priors. then its gonna be them who pays. I guarantee they dont go to jail. But I bet they dont get a dime.

Not to stand up for the cops (I think they are overreacting), but I'm going to have to call b.s. on the kids' story of "we accidentally hit him with an errant snowball". Yeah, right. That's the kind of story you told your mom when you were curious if you were accurate enough with a frisbee to hit that kid over there.

That's a great idea! And maybe then we can get Madame Cleo to perform a tarot reading and determine what punishment is to be found in their future. Better yet, let's get the judge a Ouija board and let the spirits of justice determine their fate.

Even if the cop's story is 100% accurate, a year in jail and a weapons charge seems a bit much for snowballs. Unless they had rocks in them...

"Criminal possession of a weapon" will be dismissed out of hand. It doesn't say what the other charges are, but if the cop is claiming to have identified himself prior to being hit with a snowball then there is likely to be an "assaulting an officer of the law" charge, which because if its seriousness will garner careful examination of the facts. Without witnesses though, it will likely all be dismissed. If none of the charges are felonies though it will very likely result in misdemeanor convictions, which would probably send at least one of the kids back to the slammer for violation of terms.

Would bet my life that both parties are lying.

I like how the report from the police stated everything as a matter of fact.

Instead of saying that the youths allegedly threw the snowballs they are reading it as it would have been written in the cops statement.

/still don't know the truth though.
