Back to this dingus. I had missed in the article yesterday that he had apparently been trying to hit this bird and had been told to knock it off. *rim shot* (sorry bad pun) Given this, I have to reverse my position and say that he should do some time just for being an idiot. Like you said though, being sent to Lansing is just about as good!

I e-mailed the GM yesterday. Here is the reply.

Thanks for your email, we appreciate your input. Our staff is working to
personally answer every call and letter, something that will take days if
not weeks.

Jae Kuk Ryu is no longer a Daytona Cub.

We have received hundreds, if not close to one thousand calls and emails
since this morning and we are working late to try to get caught up.


We are not trying to send out a blanket explanation, but many of the calls
and letters are very, very similar; hence, we have included here our
response to this serious incident.


We would hope that you would please understand that we are as deeply hurt
over this incident as you are. In addition to the Ospreys, we have ducks and
squirrels in the ballpark that we feed and provide for on a regular basis.
We are indeed upset.


Below is our press release sent to media outlets.


The Daytona Cubs have designated Friday, April 25th as Ozzy & Harriet Night
at the Ballpark in reference to the pair of Ospreys that for a long time
have called Jackie Robinson Ballpark home.


One of the Ospreys was hit by a baseball purportedly thrown by Cubs Pitcher
Jae Kuk Ryu. Animal Control Officers were summoned and the bird was taken to
the Animal Clinic of Edgewater for medical treatment.


"The Daytona Cubs had no knowledge of this type of activity and further
would never condone animal abuse actions. We ask that the community please
understand that the alleged actions of one player do not erase the efforts
of the remainder of the Daytona Cubs team in community events, fundraising,
and other positive activities," stated Daytona Cubs General Manager Buck
Rogers. "The Daytona Cubs, as well as the entire community, greatly regret
any harm that comes to any bird or animal, especially our very own Osprey,
Ozzy. Hundreds of calls and emails have come into our office and we will
respond to all of them."


On Friday night, the Daytona Cubs will conduct a fundraiser benefiting the
Animal Clinic of Edgewater, a veterinary clinic that relies solely upon
donations for its operations.


The Daytona Cubs will be auctioning off season tickets and other baseball
paraphernalia. The Chicago Cubs have donated autographed baseballs from
Chicago Cubs Manager Dusty Baker, Mark Prior, Kerry Wood, Moises Alou, and
will also donate $1 per person of the number fans in attendance at the game.
Andy Dunn, the VP of Brevard Operations of the Montreal Expos, has donated
the use of a luxury suite at Space Coast Stadium for a future Daytona Cubs
game and $250 cash. Daytona Cubs owner Andy Rayburn will match the entire
amount raised on this fundraiser.


"From our ownership down to our front office staff, we share the anguish of
the community surrounding this tragic event. When it came to our attention
that the Animal Clinic of Edgewater exists on private donations, we decided
that a fundraiser to assist the people responsible for healing Ozzy is
something positive that can come out of this negative incident," said
Rogers.


Animal Technician Jennifer Rosenfeldt, of the Animal Clinic of Edgewater,
when informed of Fridays fundraiser, replied, "I think its fantastic that
youre taking this step."

Uhh, he hasn't been "sentenced" yet -- the team simply demoted him. The local DA still has to file charges, then convict him before there's a sentence.

I'm guessing he'll get a relatively heavy fine, but that's about it.

Actually, the D.A. and the State of Florida Department of Natural Resources both get to investigate him -- the Osprey is a protected bird. That means that there could even be federal charges.

I bet he feels pretty stupid about now.

Sparks I'm sure he'd have gotten a much harsher sentence if he had purposely knocked out a human's eye with a fastball. Don't let it bother you. It's not 'animals before humans' it's 'animals AND humans'. It's just that the animal can't file a lawsuit on his own, so humans are lending a hand. It's that whole communication barrier thing.

anyways...how long until we start hearing about this freak using the cows for target practice in Lansing?

I'm not trying to split hairs, Sparks -- I'm just pointing out that he really hasn't been punished yet (except by the team) and that he probably will be punished later.

We'll see what happens and if this is more/less than what would happen if he hit a human.

Anyone out there think that the penalty for hitting an osprey with a baseball is greater than hitting a person? Story said that this asshat could be fined $500 and spend 60 days in jail. Let's look at the corrolary crime for a human: Battery.

Florida Statute 784.03 Battery; felony battery.--

(1)(a) The offense of battery occurs when a person:

1. Actually and intentionally touches or strikes another person against the will of the other; or

2. Intentionally causes bodily harm to another person.

(b) Except as provided in subsection (2), a person who commits battery commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

Here's the sentencing statutes:

775.082 Penalties; applicability of sentencing structures; mandatory minimum sentences for certain reoffenders previously released from prison.--

(4) A person who has been convicted of a designated misdemeanor may be sentenced as follows:

(a) For a misdemeanor of the first degree, by a definite term of imprisonment not exceeding 1 year;


775.083 Fines.--

(1) A person who has been convicted of an offense other than a capital felony may be sentenced to pay a fine in addition to any punishment described in s. 775.082; when specifically authorized by statute, he or she may be sentenced to pay a fine in lieu of any punishment described in s. 775.082. A person who has been convicted of a noncriminal violation may be sentenced to pay a fine. Fines for designated crimes and for noncriminal violations shall not exceed:

(d) $1,000, when the conviction is of a misdemeanor of the first degree.


So, for people like Sparks who still don't get it:

Osprey: $500 and/or 60 days.
Person: $1000 and/or up to one year.

Oh, and if Ozzy were to lose his eye, and we were to assume that the human victim were to also lose an eye, the crime would be "aggravated battery", which carries a sentence of up to 15 years in prison.

Excellent. Zenmaster has proven he can search the web. The laws don't mirror real life. Much harsher SENTENCES are handed down for animal cruelty than for cruelty to your fellow man. Regardless of what the LAW is.

If you punch your brother, you get a room for a night. If you're 25 and you punch a 15-year-old, you might get a week. If you punch a retarded 15-year-old, you start counting months. See the progression here? If you indicate that you pick on those weak and unable to defend themselves, you indicate you are more of a risk to a civilized society, and harsher "rehabilitation" is neccesary. Comprende?

There's a difference between MAXIMUM sentencing and the real sentence. He won't receive 60 days in prison, i'm still puzzled you can't figure that on your own.

Humans have been putting their interest over animal's for centuries, and see what it has gotten us into. Thousands of species extinct. And we're supposed to be the intelligent ones ?

I wish we were instinct...

How do you demote some one who is already in the CUBS chain? These perennial losers are a sad excuse for a baseball team. Living on the north side of Chicago I am forced to deal this this suck-ass team and their assclown fans. But more to the point why do they keep shuffling around their degenerate players like the Catholic church with buggering priests? Just a couple of years ago they had this pitcher in their farm team who blinded a guy with a brush-back pitch. Only problem was, the guy was on deck at the time.

I think there are enough guys out there who want to play baseball that the Cubs don't have to keep these 2 on any of their rosters. In the long run it won't make a difference anyway because the Cubs blow more than Madonna trying to get another movie roll. Sure it's just a bird, I don't care if it's protected or not, this type of cruelty should not be tolerated. It wasn't an accident.

AM Jevidon- Get a clue. Do you think this guy is here because he wants to be a citizen? Get real. He is no different than American players in Japan.
