"This is a clear violation of his right to due process," said Allen.

Um, no dad, it's not. The kid was irresponsible and it bit him in the ass. Don't blame the city.

The lesson here should be that if you borrow something, return it. You don't get to keep library DVDs.

Remember folks about the FBI warning at the start of every DVD or Blu-Ray, that includes rentals too.

Besides, who returns DVDs or Blu-Rays to a physical store today? The teen must not have the internet for good reasons.

"Well, let me tell you something, funny boy. Y'know that little stamp, the one that says "New York Public Library"? Well that may not mean anything to you, but that means a lot to me. One whole hell of a lot. Sure, go ahead, laugh if you want to. I've seen your type before: Flashy, making the scene, flaunting convention. Yeah, I know what you're thinking. What's this guy making such a big stink about old library books? Well, let me give you a hint, junior. Maybe we can live without libraries, people like you and me. Maybe. Sure, we're too old to change the world, but what about that kid, sitting down, opening a book, right now, in a branch at the local library and finding drawings of pee-pees and wee-wees on the Cat in the Hat and the Five Chinese Brothers? Doesn't HE deserve better? Look. If you think this is about overdue fines and missing books, you'd better think again. This is about that kid's right to read a book without getting his mind warped! Or: maybe that turns you on, Seinfeld; maybe that's how y'get your kicks. You and your good-time buddies. Well I got a flash for ya, joy-boy: Party time is over."

Damn you, texastag for beating me to the draw.

But the important question is; did he rewind the DVD first?

2010-03-08 03:59:27 PM
How did this get escalated to a criminal proceeding ?

Wouldn't this fall under civil litigation ?

I don't see how failure to return a library book, movie etc falls under the jurisdiction of law enforcement. Isn't this why they have fees for overdue stuff ?

Sorry bud, "forgetting to return" can also be called "stealing."

Don't be thief if you don't want to get arrested.

The library is being cheated. $30 for a dvd movie? WTF. Is that city/public library gouging prices?

If the city was so right, why did they reimburse the family and clear the kid's record?

Reminds me of this one time I rented Star Wars: Jedi Power Battles from a Blockbuster. I had it for a few months, then it just disappeared one day. I'm not sure that thing ever got returned. They never called, so I assume my roommate took it back.

Then again, I could have a warrant out for my arrest if I ever step back in that Blockbuster.

2010-03-08 04:06:47 PM
Wow,my library gives a 14 day grace period after the due-date, and even then I didn't get a fine of any kind. They were just happy to have the book returned

Library should have known it was a mistake because it was House of Flying Daggers, not Jackass 2 or something.

"The city attorney told me, they weren't concerned about due process. What they were concerned about was their DVD."

Half a million punitive and a six month to a year suspension of your license to practice law should fix that for you.

2010-03-08 04:13:02 PM
$30 my ass. Why don't they go after people who scratch the crap out of those DVDs. A lot of them don't even work.

gund: The library is being cheated. $30 for a dvd movie? WTF. Is that city/public library gouging prices?

Libraries can't buy prices at normal rates, licensing fees, etc.

You think netflix buys their DVDs at the same rates you do?

2010-03-08 04:18:37 PM
Why didn't he return the crappy movie?

If it's anything like library books, the library's info is stamped all over it.

And why go to the library? Download it off the internet like everyone else.

ne2d: If the city was so right, why did they reimburse the family and clear the kid's record?

'cause daddy's a fireman. He works for the city. Also, because the city is more concerned about their reputation than they are about a DVD.

But the kid is still at fault for being irresponsible. If the car dealer allows me to test drive a car and I don't bring it back, can I just say "I forgot" and be forgiven? The only difference is the value of the item. It's still a crime called "larceny by conversion."

I expect when you buy 1000 copies at a time like netflix, there's probably a discount. The library bought 1 or 2? And probably bought from some gov't approved source which cost more than wal-mart or amazon anyway.

ne2d:

Because even if they're right, it's not worth the hassle of going through the legal process if the family continues to raise a stink.

because that's stealing too. You can't be sure you're not breaking some law by sneezing in this country sometimes.

Yeah i was going to say this. Having worked at both a library and DVD place I can say they don't pay the same amount as regular consumers pay. At the rental place we had dvd's worth $60-$70. It was always fun to explain that to customers who lost movies...

2010-03-08 04:23:00 PM
I'm guessing either this kid was too lazy to fill out a change of address card, or he got his many letters from the library and ignored them. Either way, fark him. I would agree that being arrested is going too far, but if the tool hadn't gotten pulled over for his speeding ticket/running red light violation that wouldn't have happened either.

At some point, it ceases to become "forgetting to return" and becomes "theft." Just like how something as simple as refusing to tuck in your uniform shirt ceases to be about the uniform procedures and becomes a case of insubordination...

that would be fine if he said it BUT all we have is the dad's word and he lacks credibility. remember this is the same dad who started off with the lack of due precess statement when it appears that the guy got at least one court notice and ignored it. do that and don't be surprised if a bench warrant follows.

2010-03-08 04:35:05 PM
I was behind a guy at the library the other day, and the librarian told him that he had start making payments, he owed them $35. Then she checked out some more books to him.

the library here must be pretty lax. I still return all my stuff on time.

I got notice from the Library last year, that I still had a book checked out from 1971. I was in 5th grade back then. The fark part of the whole deal? They had to track me down, because I didn't live in that State any more. They wanted me to either return the book, or pay for the book plus fines. I told them to fark off. I haven't heard another thing from them.

No, a bench warrant was issued. That's when it became criminal. No matter what, if you are summoned, you have to go to court. The only reason this was dropped was due process. No one ever officially contacted the kid.

2010-03-08 04:51:27 PM
I understand why the library needs their movie or money, but arresting the kid? C'mon! Isn't there a way the library could have looked up relatives names and gotten his new number or something?

/Collection agencies tend to be able to search out anyone and everyone I know in their efforts to contact me
//Owe waaay more than 30 bucks and late fees and haven't yet been arrested for it

The person in that post is likely referring to some hypothesized digital age, where the vast majority new readable material ( as well as an increasing pool of older material ) is or will soon be available in a machine readable format thereby making traveling to a physical location in order to borrow or purchase content obsolete.

Sounds like science fiction to me though.

"As a result of Henson's story, the mayor of Littleton, Doug Clark, issued a statement to 7NEWS saying the city going to change its policy and. "We're not going to arrest people who don't return $30 DVDs."

Unless they're black or something.

and "If the car dealer allows me to test drive a car and I don't bring it back, can I just say "I forgot" and be forgiven? The only difference is the value of the item. It's still a crime called "larceny by conversion."

You can't tell the difference between an automobile and a dvd? Do you really think the only difference is the price. You can't see how somebody could legitimately forget about a dvd but how that same person couldn't really honestly forget that to return a car after a test drive?

Moran.

"But, in the latest development, the Louisville city attorney contacted the family and agreed to reimburse them for all arrest and court related costs as well as strike the arrest from the teens permanent record."

Why would the Louisville city attorney have anything to do with it? Littleton and Louisville aren't anywhere close to each other (over an hour apart).

Hell, they should be happy that anyone even uses the "li-berry" anymore. (Aside for the homeless who piss behind the books down the history aisle).
