Here in Orange County California, the Sheriff a couple years back, was put in jail for some corruption charge. (a side note, something like 4 of his 6 assistant sheriffs had run ins with the law and had to resign over the period of time he was in charge.) Now granted he was charged with something like 8 counts and was only convicted on 1 or 2, but the judge allowed him to hold on his jail sentence for like a month until his son graduated from high school so he could be there.

actually, the role of the state is simply to enforce the will of the sovereign, which can entail anything. the sovereign defines which rights (which are ethical considerations) will be protected by law, not which rights exist in ethical terms.

law has to be rooted in ethics. if it is not, then it has no legitimacy because it wouldn't reflect the social consciousness (durkheim). if the law imposed by a particular ruling sovereign did not reflect the ethics embedded within the social consciousness, then the sovereign would simply not be able to maintain power (maybe durkheim would say that society would simply crumble).

anyway, bentham does a better job (and obviously predates singer) outlining the utilitarian, pro-animal-rights argument as far as ethics are concerned.
